This chapter may be cited as "Town of Amherst Regulations for Parks, Playgrounds and Recreation Areas."
As used in this chapter, the following terms shall have the meanings indicated, and all other terms and words shall be given their common meanings:
MOTOR VEHICLE
All such vehicles as defined in the Vehicle and Traffic Law of the State of New York and, in addition thereto, minibikes, mopeds, snowmobiles, all-terrain vehicles and all other motorized recreational vehicles.
RECREATION AREA
Includes the Audubon Recreation Center, Clearfield Community Center; all parks, playgrounds, athletic fields, tennis courts, golf courses, trailways, bikeways, jogging paths and swimming pools owned and operated by the Town of Amherst outside of the Village of Williamsville and such other recreation areas as may come under the control and jurisdiction of the Town of Amherst.
A. 
No person shall operate any motor vehicle in or on any recreation area, except on the roads and within the spaces specifically designated for parking.
B. 
This restriction shall not apply to golf carts as used upon Town golf courses within designated areas.
No person shall park, stand, store or leave a motor vehicle within or on a recreation area except in the portions thereof specifically designated for that purpose and only during the hours when use of the area is permitted. Proof of ownership shall be presumptive evidence in an action for enforcement of this section that the owner parked, caused his vehicle to be parked, left standing, stored or left his vehicle within such recreation area.
No person shall:
A. 
Swim, bathe or engage in boating in or upon any pond located within a recreation area.
B. 
Permit a dog, cat or other animal to be in or on a recreational area during special events as determined by the Town Board and at all other times unless on a leash not exceeding six feet in length.
C. 
Engage in any type of golfing activity in any recreation area except on Town golf courses.
D. 
Be in or upon the grounds or within the buildings of any recreation area for any purpose between the hours of 10:00 p.m. and 6:00 a.m. without prior written permission from the Recreation Commission.
E. 
Sell goods, merchandise and/or services within any recreation area without a permit issued by the Town Clerk with the approval of the Town Board.
F. 
Leave, deposit or discard any garbage or refuse, as defined in the Garbage and Refuse Ordinance,[1] in or on any recreation area, except in receptacles provided for such purpose.

G. 
Transport onto any recreation area garbage or refuse, as defined in the Garbage and Refuse Ordinance, with the intent to deposit the same in receptacles provided on premises for garbage and refuse.
H. 
Be under the influence of alcohol in or on a recreation area to the degree that he may endanger himself or other persons or property or annoy persons in the vicinity.
I. 
Possess alcoholic beverages within any recreation area unless a permit is issued therefor by the Town Clerk upon the approval of the Town Board.
J. 
Bring into or have in his or her possession within a recreation area any bottle or other container made of glass.
K. 
Operate a motor vehicle or other recreational device on or within a recreation area at a speed of more than 15 miles per hour or of any such lesser speed which has been ordered by the Recreation Commission and posted.
L. 
Use skateboards or similar devices in or on a recreation area except where designated for such use.
M. 
Operate a bicycle on or within a designated recreation area unless it conforms to the requirements of § 1236 of the Vehicle and Traffic Law.
A violation of any provision of this chapter shall be an offense punishable by a fine not to exceed $150 or imprisonment for 15 days, or both.
This chapter shall become effective immediately.
