The user shall provide necessary wastewater treatment as required to comply with the provisions of this Part 1, any applicable federal categorical pretreatment standards, and all other applicable federal, state and local pretreatment standards within the time limitations as specified by the applicable pretreatment standards, whichever is more stringent. All facilities required to pretreat wastewater to an applicable level acceptable to the Town shall be provided, operated and maintained at the user's expense. Detailed plans showing the pretreatment facilities and operating procedures shall be submitted to the Town Board for review, and shall be approved by the Town Engineer, subject to the requirements of applicable codes, ordinances and laws, prior to construction of the facility. The approval of such plans and operating procedures will in no way relieve the user from the responsibility of modifying the facility as necessary to produce an effluent acceptable to the Town under the provisions of this Part 1. Any subsequent changes in the pretreatment facilities or method of operation shall be reported to and approved by the Town Engineer prior to the user's initiation of the changes.
A. 
Whenever deemed necessary, the Town Engineer may require users to restrict their discharge during peak flow periods, designate that certain wastewater be discharged only into specific sewers, relocate and/or consolidate points of discharge, separate sewage waste streams from industrial waste streams and such other conditions as may be necessary to protect the POTW and determine the user's compliance with the requirements of this Part 1.
B. 
The Town Engineer may require any person discharging into the POTW to install and maintain, on his/her property and at his/her expense, a suitable storage and flow-control facility to ensure equalization of flow. A wastewater discharge permit may be issued solely for flow equalization.
C. 
Users with the potential to discharge flammable substances may be required to install and maintain an approved combustible gas detection meter.
D. 
Grease, oil and sand interceptors shall be provided, replaced and maintained by industrial and commercial users to service all discharges containing sand, fats, grease or oils as required by the Town Engineer. All proposed interceptors shall be sized in accordance with specific sizing criteria established by the Town of Amherst, based on a minimum detention time of 30 minutes under calculated loads. The installation of the unit must be installed in accordance with the applicable plumbing codes and standards. All proposed interceptor installations, including retrofits and replacements, must be approved by the Town of Amherst Engineer.
(1) 
A food waste grinder is not permitted to discharge into a grease interceptor unless the interceptor has been designed for such an application, or unless a solids interceptor has also been installed upstream of the grease interceptor device.
(2) 
The interceptor units shall be so located outside of the building to be easily accessible for cleaning, inspecting and sampling. Such interceptors shall be inspected, cleaned and repaired regularly, by the user at his/her expense, to the satisfaction of the Town. If, in the opinion of the Town Engineer, any existing interceptor units are undersized or in need of repair, the Town Engineer can order the industrial or commercial user to replace the existing unit with a new interceptor meeting the town's requirements.
(3) 
New and existing grease interceptors and oil separators shall be maintained in efficient operating condition by periodic removal of the full contents of the interceptor which includes wastewater, accumulation FOG, flooding materials, sludges and solids from interceptor walls, baffles and floors.
(4) 
All existing and newly installed grease interceptors and oil separators shall be maintained in a manner consistent with maintenance frequency approved by the Pretreatment Coordinator pursuant to this section.
(5) 
No FOG that has accumulated in the grease interceptors or oil separator shall be allowed to pass into any sewer lateral, sewer system, storm drain, or public right of way during maintenance activities.
(6) 
If the grease interceptor or oil separator, at any time, contains FOG and solids accumulation that does not meet the requirements described in this local law, the user shall be required to have the grease interceptor or oil separator serviced within five (5) business days such that all fats oils, grease, sludge, and materials, including water are completely removed from the grease interceptor or oil separator. If it is determined that an overflow or blockage situation exists, the interceptor or oil separator shall be serviced immediately. If deemed necessary, the Pretreatment Coordinator may also require an increase in the maintenance frequency of the grease interceptor.
(7) 
Waste water, containing accumulated FOG, floating materials, sludge/solids and other materials removed from the grease interceptor, oil separator, grease trap, or other pretreatment device shall be properly disposed in accordance with federal, state and/or local laws.
(8) 
Rules and regulations regarding the monitoring, reporting, notification and inspection requirements for grease trap/interceptor maintenance are available on the Town's website and shall be followed by users with grease trap/interceptor installations.
At least once every two years, the Town Engineer shall evaluate whether each significant industrial user needs an accidental discharge/slug control plan. The Town Engineer may require any user to develop, submit for approval, and implement such a plan. Alternatively, the Town Engineer may develop such a plan for any user. An accidental discharge/slug control plan shall address, at a minimum, the following:
A. 
Description of discharge practices, including nonroutine batch discharges.
B. 
Description of stored chemicals.
C. 
Procedures for immediately notifying the Town Engineer of any accidental or slug discharge, as required by § 160-36 of this Part 1.
D. 
Procedures to prevent adverse impact from any accidental or slug discharge. Such procedures include but are not limited to inspection and maintenance of storage areas, handling and transfer of materials, loading and unloading operations, control of plant site runoff, worker training, building of containment structures or equipment, measures for containing toxic organic pollutants, including solvents and/or measures and equipment for emergency response.
A. 
All waste haulers and generators must use the Town of Amherst wastewater discharge permit application and Treatment Schedule Manual for Hauled Wastewater.
B. 
All hauled waste shall be introduced into the POTW only at locations designated by the Town Engineer and at such times as are established by the Town Engineer. Such waste discharge shall not violate any provision of this Part 1 or any other requirements established by the Town. The Town Engineer may also prohibit the disposal of hauled waste at any time for any operational, environmental or safety reason.
C. 
The Town Engineer shall require all haulers and generators of hauled waste to obtain Town of Amherst wastewater discharge permits.
D. 
The Town Engineer may collect samples, and analyze such collected samples, of each hauled load to ensure compliance with applicable standards and charge the hauler or generator, all costs attributed to such sampling and analysis. The Town Engineer may require the waste hauler to provide a waste analysis of any load prior to discharge.
E. 
All waste haulers must obtain a NYSDEC waste transporter permit.
F. 
Prior to discharge to the Town, all hauled, nondomestic wastewater must be certified in writing to be nonhazardous under RCRA by both the generator and the hauler.
G. 
If a user located within another municipality hauls wastewater to the POTW, the Town Board shall enter into a contract with the user. The contract shall contain, at a minimum, the following conditions:
(1) 
A provision ensuring the Town Engineer the right to enter the users premises at any reasonable time for the purpose of inspecting the entire premises, sampling, examining and copying records, and any other duties deemed necessary by the Town Engineer; and
(2) 
A provision specifying that the user will be subject to the Town Board's enforcement powers, as set forth in the Town of Amherst Local Sewer Use Law.
H. 
The Town of Amherst will inspect those IUs which are generators of wastewater hauled to the Town's POTW at a minimum frequency of once per year.
