GENERAL REFERENCES

As used in this chapter, the following terms shall have the meanings indicated:
ABANDONED OR JUNKED AUTOMOBILES
Any motor vehicle or part thereof, including any motor, and also including any body of a motor vehicle, whether with or without motor, which is inoperable, or does not have a current and valid license, registration or inspection sticker as required by the Motor Vehicle Code of the Commonwealth of Pennsylvania; provided, however, that such term shall not mean farm machinery which is actually used in connection with a bona fide farming operation.

NUISANCE
Any act which causes injury, damage, hurt, inconvenience, annoyance or discomfort to or interferes with or creates an inconvenience to the rights of the public or the neighborhood or any members thereof.

PERSON
Any natural person, association, partnership, firm or corporation.

A. 
No person shall park, store or leave any abandoned or junked automobile on public property or on private property in such a manner as to create a nuisance.
B. 
No person shall permit any abandoned or junked automobile to be parked, stored or left on private property owned by that person in such a manner as to create a nuisance.

Any person who violates any provisions of this chapter shall commit a criminal offense, and shall, upon being found guilty by a Magisterial District Judge, after hearing, pay a fine not to exceed $1,000, together with all court costs as permitted by law. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day of violation shall constitute a separate offense, which shall be subject to prosecution as such. For purposes of this section, the Board of Supervisors of East Manchester Township hereby appoints the Township Manager, Secretary, Zoning Officer, Permit Officer or Codes Enforcement Officer as authorized representatives, any one of whom, in addition to any police officer with jurisdiction within the Township, may commence and pursue enforcement proceedings pursuant to this section.
