As used in this chapter, the following terms
shall have the meanings indicated:
Any library in which the holder of a registration card shall
be entitled to borrow material as a consequence of the possession
of such card.
Includes any individual, cosigner of a library registration
card, corporation, partnership, association or other entity.
It shall be unlawful for any person to detain,
fail or refuse to return any book, periodical, pamphlet, recording,
audiovisual materials or any other article of any kind borrowed from
the Ridgefield Park Public Library, or from any affiliate library,
with the use of a Ridgefield Park Free Public Library registration
card for a period exceeding that time allowed for the material's use
by the borrower, as may be established pursuant to the rules and regulations
of the respective library.
A.
In the event that any person shall detain or fail
to return any material within the above-stated prescribed time, there
may be forwarded to such person, at any time thereafter, notice of
delinquency by certified mail, return receipt requested. Such notice
shall be forwarded to the persons's last known address as stated on
the registration card or otherwise noted on the record of the Ridgefield
Park Public Library.
B.
Should any person thereafter detain or fail to return
any item for a period of 30 days or more from the date of mailing
notice of delinquency, such person shall be fined in accordance with
the provisions of this chapter.
This chapter shall be enforced by the Library
Director or his or her authorized representative.
For each and every violation of the provisions
of this chapter, the person as herein defined, upon conviction, shall
be subject to a fine of not more than $100 or imprisonment not exceeding
90 days, together with the cost of the replacement value of the item
not returned and costs of court.
