A. 
Before any outdoor display and sales can be conducted, other than the routine sidewalk sales which occasionally occur, persons desiring to conduct such display and sales shall submit an appropriate application to the Village Clerk requesting permission from the governing body to permit the outdoor display and/or sale of merchandise on the sidewalk outside their business and adjoining area, subject to the conditions set forth in this chapter.

All sidewalk display and sale of merchandise shall only be conducted by owners of businesses located within the C-1(H) Central Business Historic District and C-2 Neighborhood Commercial Zones, or in other zones by businesses similar to those permitted in the C-1(H) and C-2 Zones, whose use of their property is in conformance with the Zoning Code of the Village of Ridgefield Park.[1] No sales or display of merchandise by third parties shall be permitted pursuant to this section.

A. 
The applicant shall provide a sketch drawing showing the area to be used for outdoor display or sale. This area shall not be an off-street parking place nor shall it be obstructive to easy ingress and egress from the building or create a fire hazard. Outdoor displays or sales shall abut the principal building and shall leave a minimum of five feet of unimpeded sidewalk, as measured from the curb, for pedestrian traffic. Merchandise shall be securely and adequately placed so that it will not endanger passersby or be stored indoors as to create a safety or fire hazard.
B. 
An application must be submitted at least 10 business days in advance of a Board of Commissioners regular meeting on a form provided by the Village Clerk in triplicate. A copy of the application shall be immediately forwarded by the Village Clerk to the Building Department, Health Department and Police Department of the Village of Ridgefield Park for appropriate comment by the respective heads of those departments, and such application shall be considered by them within three business days after receiving the application and their comments noted thereon in the specified place.
C. 
Upon review of such application by the department heads, a copy of the application shall be forwarded to all members of the Board of Commissioners for further review. After the Board of Commissioners has reviewed all of the comments it may adopt a resolution permitting the outdoor display and/or sale of merchandise on sidewalks and adjoining areas subject to conditions that may be set forth in the resolution.
D. 
No applicant shall commence any activity permitting the sale or display of goods and merchandise without the approval from the Board of Commissioners.
E. 
No applicant shall be permitted to sell food and foodstuffs or have them offered for sale unless approved and an appropriate permit, where necessary, has been obtained from the Board of Health.
All applicants shall be governed by the following general regulations:
A. 
The outdoor display and sale shall be restricted to areas zoned for business and be in accord with all zoning regulations pertaining thereto.
B. 
All participating displayers or sellers shall own or lease permanent premises where the outdoor display or sale will be conducted.
C. 
The permit shall not adversely affect the public welfare.
D. 
No merchandise shall be hung from outdoor lines, blinds or signs, except from May 15 to June 30 of each calendar year.
A. 
The permit shall be good for one year and shall generally run from April 1 through March 31 of each calendar year.
B. 
If during the course of the permit the area used for outdoor display is expanded or changed, a new application shall be required for the balance of the term of the existing permit, and the applicant shall be required to pay a new fee of $35 in addition to the initial permit fee.
Each application for a permit shall be accompanied by a fee of $75. All applicants shall fill out a form provided by the Village Clerk and pay the fee before the application shall be processed in accordance with this chapter.
This chapter shall not apply to sidewalk sale days approved by the Board of Commissioners by an appropriate resolution. Such sidewalk sales shall not occur more than three times a year for a period of no more than six consecutive business days.
The enforcement provisions of this chapter shall be under the jurisdiction of the Building Department of the Village of Ridgefield Park and the Police Department and Board of Health, where necessary.
Any person, firm or corporation who shall violate any of the provisions of this chapter shall be punishable, upon conviction, as provided in Chapter 1, General Provisions, Article II, General Penalty.
