Township of Kingwood, NJ Chapter 104 Soil Replacement

§ 104-1 Title.

The title of the provisions of this chapter shall be "Soil Replacement."

§ 104-2 Definitions.

The definitions of the terms "excavation" and "natural ground surface" shall be the definitions of those terms as set forth in § 103-2 of Chapter 103 of the Kingwood Code.

§ 104-3 Soil replacement requirements.

As to all excavations undertaken in the Township of Kingwood, once an excavation that is to be refilled to the level of the natural ground surface has been completed, soil material shall be replaced in the excavation in the reverse order that it was removed, restoring the original soil layers, after which the soil material shall be compacted and the area returned to the preexisting natural ground surface to the greatest extent practicable.

§ 104-4 Violations and penalties.

Any person who willfully or knowingly violates any provision of this chapter shall, upon conviction thereof, be subject to the penalty provisions in Chapter 1, General Provisions, Article II, General Penalties, of the Township Code. Each day of violation of any provision of this chapter shall constitute a separate offense for which a separate penalty may be imposed.
