The Township Committee of the Township of East Hanover hereby determines that any person who assists in the detection and apprehension of any person found guilty of purposely or knowingly damaging tangible property of another by an act of graffiti in violation of N.J.S.A. 2C.17-3 shall be eligible for a reward in an amount not to exceed $500.
Said reward shall be paid out of funds of the township specifically set aside in the township budget for the payment of said rewards and shall only be payable upon and after the conviction of such person charged with a violation of N.J.S.A. 2C:17-3.
Said reward shall only be made to such person upon resolution of the Township Committee after review and written recommendation of the Chief of the Township Police Department is received and it is determined in the sole discretion of the Township Committee that such person is entitled to said reward. The Chief of the Police Department shall set forth the reasons why said person is entitled to said reward and the recommendations as to the same.
Notwithstanding any of the above, no reward shall be paid to any public employee whose duty is to investigate or to enforce the law or to such employee's spouse, child or parent living in the same household.
For the purpose of this Article, the following terms shall have the meanings indicated:
ACT OF GRAFFITI
The drawing, painting or making of any inscription on or otherwise defacing a bridge, building, public transportation vehicle, block, wall, sidewalk, street or other exposed surface on public or private property without the permission of the owner.
