In a "D-4" Special Business District, the regulations set forth in this chapter shall apply.

In a "D-4" Special Business District, a building may be erected or used, and a lot may be used or occupied, for any of the following purposes and no other:
(a) 
A retail store selling or leasing for local neighborhood use one or more of the following items at retail: food, groceries, meats, vegetables, fruit, drugs, cosmetics, hardware, clothing, jewelry, watches, optical goods, nursery stock or musical, professional or scientific instruments.
(b) 
An office, bank or financial institution.
(c) 
A personal service shop of a dressmaker, shoe repairer, tailor or hairdresser.
(d) 
Medical offices of a private practitioner, other than a clinic.
(e) 
An undertaker, but not including a crematorium.
(f) 
A baker, confectioner or custom shop for the production of articles to be sold only on the premises.
(g) 
A restaurant and a catering establishment, when authorized as a special exception by the Zoning Hearing Board.
(h) 
A municipal use.
(i) 
Any use similar to those specified in Subsections (a) through (g) hereof, when authorized as a special exception by the Zoning Hearing Board.

An automobile sales agency.

(a) 
Minimum Lot Area. A lot area of not less than 30,000 square feet shall be provided for every building or use specified in Section 1286.02(a) to (i). A lot area of not less than 40,000 square feet shall be provided for every building or use specified in Section 1286.02(j).
(b) 
Minimum Lot Width. A lot width of not less than 200 feet shall be provided for every building or use, at the ultimate right-of-way. If the lot is a corner lot, this lot width must be provided on both frontages.

(a) 
Front Yards. There shall be a front yard on each lot which shall not be less than 30 feet.
(b) 
Side Yards. There shall be two side yards on each lot, neither of which shall be less than 30 feet.
(c) 
Rear Yards. There shall be a rear yard on each lot which shall not be less than 50 feet.
(d) 
District Yard. A side yard or rear yard adjacent to any residential district shall not be less than 100 feet.

(a) 
Building Coverage. In a "D-4" Special Business District, the total building coverage shall not exceed 20%.
(b) 
Impervious Coverage. The total impervious coverage shall not exceed 50%.

The maximum height for buildings or other structures erected or enlarged in a "D-4" Special Business District shall be 30 feet, not exceeding one story.

(a) 
Parking and Loading. All weather off-street parking and loading facilities shall be provided in accordance with Chapter 1294.
(b) 
Display of Vehicles for Sale. Parking required by Chapter 1294 shall not be used for the storage or display of motor vehicles for sale or lease. Required parking shall be segregated from such display or storage areas and shall be clearly indicated by means of a sign, striping or other identification as customer and employee parking.
(c) 
Setbacks. No parking, loading or driveway area shall be located closer than 20 feet to any side or rear property line, nor closer than 25 feet to any front property line.

(a) 
Signs. Signs shall be permitted in accordance with Chapter 1292.
(b) 
Gross Building Floor Area. No building, whether containing a single use or several uses, shall contain a gross area greater than 6,000 square feet of floor area, including unoccupied basements. No request for a variance from this subsection shall be granted without a proportionate or equivalent increase in the yard areas, as determined by the Zoning Hearing Board.
(c) 
Landscaping. All development in the "D-4" Special Business District shall be designed and maintained in accordance with Sections 1234.05, 1238.16 and 1238.17(f) of the Subdivision Regulations. In addition, there shall be a suitable and effective landscape barrier at the edge of the property adjacent to any public street. Such buffer strip shall be at least 10 feet wide and shall channel motor vehicle ingress and egress from the property, providing a maximum of one access road per 200 feet of frontage and in no case more than two access roads per property.
(d) 
Utilities. All development in the "D-4" Special Business District shall be served by public sewer and water. All utilities serving a permitted use in this district shall be underground.
(e) 
Outdoor Land Use. There shall be no outdoor storage or display of goods or materials for marketing, storage or any other purpose. However, automobile sales agencies may store and display automobiles outdoors and nursery stock establishments may display and store living plant materials outdoors. The outdoor storage of trash shall be designed and maintained to be completely screened from view by a landscape buffer.
(f) 
Distance Between Structures. If there is more than one structure on a site, the minimum distance between structures shall be 30 feet. For the purpose of this section, any open canopy-type structure or roof overhang shall be considered in the same manner as an enclosed building.
(g) 
Site Lighting. Exterior lighting provided in conjunction with any building or use shall be placed not higher than 14 feet above grade and shall be screened so as not to permit the source of illumination to be seen from off of the premises. Only incandescent or color-corrected types of illumination shall be used. The hours of operation of such lights shall be limited to normal business hours, and in no case shall such lights remain illuminated between 12:00 midnight and 6:00 a.m., prevailing time.[1]

In addition to the Statement of Community Intent provided in Section 1250.02, the specific intent of the "D-4" District shall be to protect the rural appearance and character of the Township while allowing for the provision of services related to vehicular transportation. The specific objectives of the "D-4" Special Business District are to:
(a) 
Combine general zoning requirements and certain restrictions necessary for special business uses to promote the general health, safety and welfare of the Township.
(b) 
Minimize danger to the public by regulating uses associated with hazardous substances.
(c) 
Protect adjacent landowners from the negative influences associated with special business uses.
