This article is for the purpose of fixing license fees and regulating the sale of alcoholic beverages in the Borough of Atlantic Highlands, County of Monmouth, in accordance with provisions of the Alcoholic Beverage Law, being Title 33, Chapter 1, of the Revised Statutes (1937),[1] as amended and supplemented, and in accordance with the rules and regulations promulgated or to be promulgated by the State Commission of Alcoholic Beverage Control applicable hereto, and in accordance with the rules and regulations existing herein or hereafter adopted by competent municipal authority not inconsistent with said Alcoholic Beverage Law or said rules and regulations of said State Commissioner.

It shall be unlawful to possess, sell, distribute or transport any alcoholic beverage in the Borough of Atlantic Highlands contrary to the provisions of Title 33, Chapter 1, of the New Jersey Revised Statutes (1937), as amended and supplemented.

The Mayor and Council of the Borough of Atlantic Highlands, County of Monmouth, being the governing body of said municipality, shall constitute the authority for the administration of the issuance hereunder.

The fees for licenses issued in the Borough of Atlantic Highlands shall be as provided in Chapter 168, Fees, Article II.

No seasonal retail consumption license shall be granted within the municipality. One club license shall be issued, it being the intention of this article to provide for the issuance of only plenary retail consumption licenses, plenary retail distribution licenses and one club license.
No license of any class shall be issued contrary to any Zoning Ordinance now existing or hereafter enacted in the municipality.

A. 
No licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage, or allow the consumption of any alcoholic beverage on licensed premises, on New Year's Day when it is a weekday between the hours of 5:00 a.m. and 8:00 a.m., on New Year's Day when it is a Sunday, between the hours of 5:00 a.m. and 9:00 a.m., on other weekdays between the hours of 2:00 a.m. and 6:00 a.m. or on other Sundays between the hours of 2:00 a.m. and 9:00 a.m. During the hours sales are prohibited, the entire licensed premises shall be closed.
B. 
The hours herein specified shall be according to such time as is then officially in use in the Borough of Atlantic Highlands.
A. 
Any person who shall sell any alcoholic beverages without having complied with or in violation of any of the provisions of this article shall, upon conviction thereof, be subject to a penalty as provided in Chapter 1, Article II, General Penalty.[1]

B. 
Any license issued pursuant to this article may be suspended or revoked for violation of any of the provisions of this article or for violation of any of the provisions of said Alcoholic Beverage Law or of any of the rules and regulations promulgated by the State Commissioner of Alcoholic Beverage Control.
