[HISTORY: Adopted by the Board of Commissioners of the Township of Lower Allen 5-11-2009 by Ord. No. 2009-07. Amendments noted where applicable.]
The new title of the oversight committee shall be the "Lower Allen Township Pension Committee."
A. 
The Pension Committee shall be appointed by the Board of Commissioners and made up of the following persons:
(1) 
Commissioner, appointed by the Board of Commissioners.

(2) 
Manager or Assistant Manager.

(3) 
Public Safety Director/Chief of Police.
(4) 
Finance Director.
(5) 
President of the Lower Allen Township Police Officers Association.
(6) 
Nonunion employee at large.
(7) 
Lower Allen Township resident.

Editor's Note: Original § 156-2B, which regarded the requirement that the resident appointed to the Committee have actuarial experience, was repealed at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
C. 
Changes in Committee membership shall be made by ordinance or resolution of the Board of Commissioners of Lower Allen Township.
A. 
All members of the Pension Committee, with the exception of the nonunion employee and the resident, shall serve on the Committee as long as they hold the position described in § 38-2A.
B. 
The nonunion employee and Township resident shall serve two-year terms, with the initial term ending on December 31 in the year following the year in which they were appointed.

Meetings of the Pension Committee shall be held annually and as otherwise called by the Manager/Assistant Manager.
The provisions of this chapter, as far as they are the same as those of ordinances in force immediately prior to the enactment of this chapter, are intended as a continuation of such ordinances and not as new enactments. The provisions of this chapter shall not affect any act done or liability incurred, nor shall it affect any such suit or prosecution pending or to be instituted to enforce any right or penalty or to punish any offense under the authority of any ordinance repealed by this chapter.
The provisions of this chapter are severable, and if any of its provisions shall be held to be unconstitutional, illegal, or invalid, such decision shall not affect the validity of any of the remaining provisions of this chapter. It is hereby declared as a legislative intent that this chapter would have been adopted had such unconstitutional, illegal or invalid provision not been included herein.
This chapter shall take effect immediately.
