A.
Pursuant
to the powers vested in the Village pursuant to Municipal Home Rule
Law § 10, Subdivision 1(ii)a(1) and (ii)e(3), the Board of Trustees
of the Village of North Hills hereby amends and supersedes §
3-301, Subdivisions 1 and 2, of the Village Law, to read as follows
with respect to the Village of North Hills:

§ 3-301. Village officers.

The Village of North Hills shall have the following officers:

a.
|
a Mayor;
| ||
b.
|
four Trustees;
| ||
c.
|
a Village Clerk-Treasurer, who may also be known and designated
as the Village Administrator; and
| ||
d.
|
a Village Attorney.
| ||
2.
|
The Village of North Hills also shall have:
| ||
a.
|
a Village Justice, and an Associate Village Justice who shall
serve when requested by the Village Justice or in the absence or inability
of the Village Justice to serve. The Board of Trustees, by resolution
or local law, subject to permissive referendum, may abolish such office,
but to take effect only upon the expiration of the then-current term
of such office, or establish the office of additional Village Justice,
which justice once elected shall have all of the powers and duties
of a Village Justice. The resolution or local law in the latter case
shall provide for a term pursuant to Village Law § 3-302; and

such other officers, including deputies, as the Board of Trustees
shall determine from time to time by resolution.

B.
Pursuant
to the powers vested in the Village pursuant to Municipal Home Rule
Law § 10, Subdivision 1(ii)a(1) and (ii)e(3), the Board of Trustees
of the Village of North Hills hereby amends and supersedes §
3-302, Subdivision 3, of the Village Law, to read as follows with
respect to the Village of North Hills:[1]

In the Village of North Hills, the term of office of Mayor,
and each Trustee, and the Village Justice shall be four official years.
The term of office of the Associate Village Justice shall be one official
year.

provisions shall not affect any term of office currently in effect
on its effective date, and that with respect to any office the term
of which expires on July 6, 2009, said law shall be applicable at
noon on July 6, 2009, and with respect to any office the term of which
expires after July 6, 2009, shall be effective upon the expiration
of such term.
C.
Pursuant
to the powers vested in the Village pursuant to Municipal Home Rule
Law § 10, Subdivision 1(ii)a(1) and (ii)e(3), the Board
of Trustees of the Village of North Hills hereby amends and supersedes
§ 3-302, Subdivision 4, of the Village Law, to read as follows
with respect to the Village of North Hills:

Except as otherwise expressly provided in Chapter 58 of the Code of the Village of North Hills, the term of office of any village officer of the Village of North Hills shall be indeterminate and at the pleasure of the Mayor; provided, however, that any officer permanently appointed to an office classified in the competitive class of the civil service shall hold such office for an indeterminate term subject to the provisions of the Civil Service Law.

D.
Pursuant
to the powers vested in the Village pursuant to Municipal Home Rule
Law § 10, Subdivision 1(ii)a(1) and (ii)e(3), the Board
of Trustees of the Village of North Hills hereby repeals § 3-302,
Subdivision 6, of the Village Law of the State of New York in its
application to the Village of North Hills.
E.
Pursuant
to the powers vested in the Village pursuant to Municipal Home Rule
Law § 10, Subdivision 1(ii)a(1) and (ii)e(3), the Board
of Trustees of the Village of North Hills hereby amends and supersedes
§ 3-300, Subdivision 2, of the Village Law of the State
of New York in its application to the Village of North Hills to read
as follows:

Except as otherwise expressly provided in this chapter, no person
shall be eligible to be appointed to or hold any other Village office
in the Village of North Hills, or to be a member of any Village board
or commission, who is not a citizen of the United States; is not at
least 18 years of age; except as otherwise authorized by resolution
of the Board of Trustees, is not a Village resident; and if eligibility
to or holding of such office is subject to regulation under the Civil
Service Law or any other law, does not meet the requirements of such
law or laws.

Pursuant to the powers vested in the Village pursuant to Municipal Home Rule Law § 10, Subdivision 1(ii)a(1) and (ii)e(3), § 3-302, Subdivisions 3, 4 and 6 of the Village Law are hereby expressly superseded by Chapter 58 of the Village Code to the extent that said provisions of the Village Law may be inconsistent with any of the provisions of this chapter.
A.
The Village of North Hills hereby establishes and continues the public
office of Village Administrator. The Village Clerk-Treasurer shall
be the Village Administrator.
B.
The Village Administrator shall have the authority and duties of
the Village Clerk and the Village Treasurer as may be provided in
the Village Law or any other statute, law or regulation of the State
of New York or as may be provided in this Code. Any reference in any
statute, law, regulation or this Code to the Village Clerk, Village
Treasurer or Village Clerk-Treasurer shall be deemed to be a reference
to the Village Administrator. The Village Administrator also shall
have such other powers and duties as may be designated from time to
time by the Board of Trustees.
C.
The Village Administrator shall be appointed by the Mayor, subject
to the approval of the Board of Trustees, for an indeterminate term,
to serve at the pleasure of the Mayor. Notwithstanding any other provision
of law to the contrary, the Village Administrator need not be a resident
of the Village of North Hills but shall be a resident of Nassau County;
provided, however, that with the consent of the Board of Trustees,
the Village Administrator may be a resident of a county adjoining
Nassau County.
D.
Compensation. The compensation of the Village Administrator shall
be established from time to time by resolution of the Board of Trustees.
A.
The
Village of North Hills hereby establishes and continues the public
office of Deputy Village Clerk-Treasurer.
B.
The
Deputy Clerk-Treasurer shall be appointed by the Mayor, subject to
the approval of the Board of Trustees, for an indeterminate term,
to serve at the pleasure of the Mayor. Notwithstanding any other provision
of law to the contrary, the Deputy Clerk-Treasurer need not be a resident
of the Village of North Hills but shall be a resident of Nassau County;
provided, however, that with the consent of the Board of Trustees,
the Deputy Clerk-Treasurer may be a resident of a county adjoining
Nassau County.
C.
Compensation.
The compensation of the Deputy Village Clerk-Treasurer shall be established
from time to time by resolution of the Board of Trustees.
A.
The Village of North Hills hereby establishes and continues the public
office of Village Attorney.
B.
The Village Attorney shall be appointed by the Mayor, subject to
the approval of the Board of Trustees, for an indeterminate term,
to serve at the pleasure of the Mayor. The Village Attorney shall
be a member in good standing of the Bar of the State of New York,
and also shall meet the qualifications and requirements of the Civil
Service Law and any other applicable law. Notwithstanding any other
provision of law to the contrary, the Village Attorney need not be
a resident of the Village of North Hills but shall be a resident of
Nassau County,
C.
The duties of the Village Attorney shall be performed at such times
and places as required by the Mayor and/or Board of Trustees. Such
duties shall include those duties as may be required by law to be
performed by the Village Attorney and such duties as may be determined
by the Mayor and/or Board of Trustees. The Village Attorney shall
perform such duties under the direction of the Mayor and Trustees,
without fixed hours, at such times and places as determined by the
Village Attorney unless otherwise required by the Mayor and Board
of Trustees.

D.
Compensation. The compensation of the Village Attorney shall be established
from time to time by resolution of the Board of Trustees.
