GENERAL REFERENCES
Fire Department — See Ch. 30.
Pursuant to P.L. 1997, c. 338 (N.J.S.A. 40A:14-183 et seq.), a Length of Service Awards Program is hereby created to reward active volunteer members of the Sergeantsville Volunteer Fire Company for their loyal, diligent and devoted service to the residents of Delaware Township.
The definitions set forth in N.J.S.A. 14A:14-184 and N.J.A.C. 5:30-14.1 are incorporated in this chapter as if set forth at length herein. The Sergeantsville Volunteer Fire Company is an "emergency service organization" as defined therein.
The LOSAP shall provide for annual contributions to a deferred income account for active volunteer members of the Sergeantsville Volunteer Fire Company who qualify as participants under the LOSAP as set forth in § 50-4 of this chapter. Such contributions shall be made in accordance with a plan established by the Township of Delaware pursuant to P.L. 1997, c. 388, administered in accordance with the laws of the State of New Jersey, the U.S. Internal Revenue Code and this chapter.
A. 
The Township shall provide for annual contributions to each participant in the amount of $1,150 per participant.
B. 
To qualify as a participant, an active volunteer member of the Sergeantsville Volunteer Fire Company shall attain 60 points in accordance with the schedule set forth in § 50-6 below in each calendar year.
C. 
Annual contributions shall only be made for those active volunteer members who have earned the minimum number of points for performing volunteer services as set forth in § 50-6.
D. 
The Sergeantsville Volunteer Fire Company shall provide to the Township of Delaware certified lists as to active volunteer members who are initially eligible to become participants in the LOSAP as of January 1 of each calendar year, commencing January 1, 2004. The Plan Administrator shall forward said certified list to the Delaware Township Committee for its approval in accordance with N.J.A.C. 5:30-14.10. The Township Committee, within 30 days of receipt of the list, shall review the list and, if necessary, request any records or any backup information deemed necessary in order to substantiate the information furnished. Upon a finding that the list is accurate, the Township Committee shall approve the list by resolution, and the list shall be posted in accordance with N.J.A.C. 5:30-14.10. Appeals from the decision of the Township Committee shall be governed by N.J.A.C. 5:30-14.11.
E. 
The Township of Delaware shall have the right to require any active volunteer member at the time of his/her becoming a participant in LOSAP to agree in writing to be bound by the terms, covenants and conditions of the LOSAP and accompanying trust. East participant shall furnish to the Township all pertinent information required for administration of the LOSAP, and the Township shall be entitled to rely upon the information furnished.
F. 
The active volunteer member shall not be permitted to receive a distribution of funds in his/her LOSAP account until completion of a five-year vesting period, which may include prior active years of service that meet the point requirements set forth in § 50-6 that occurred prior to establishment of the LOSAP.
G. 
Any participant who terminates service as an active volunteer member shall cease to participate in the LOSAP, and no contribution shall be made by the Township on his/her behalf. A former participant may resume participation immediately upon returning to the service of the Sergeantsville Volunteer Fire Company as an active volunteer member and shall be treated as a new participant for purposes of eligibility. Any active volunteer member who was fully vested and terminates service with the Sergeantsville Volunteer Fire Company and subsequently returns to service and again becomes a participant shall receive credit for his/her former years of eligible service and shall resume participation in the same manner as prior to his/her termination.
H. 
Should a volunteer fail to vest or otherwise terminate his/her membership with the Sergeantsville Volunteer Fire Company prior to completion of vesting, funds deposited in the LOSAP account on his/her behalf shall revert to the Township.
The estimated cost of the LOSAP for the year 2004 is $40,250.

Each active volunteer member shall be credited annually on December 31 with points for volunteer services provided to the Sergeantsville Volunteer Fire Company in accordance with the following schedule:
Point System
60 points needed for a qualifying year
Fire Calls — The maximum will be the total number of fire calls each year.
Drills — 48 points maximum
Every drill attended will equal 2 points; excused absences do not count.
Work Nights — 24 points maximum
Every work night attended will equal 1 point.
Training Courses — 25 points maximum
Every two hours of training will equal 1 point.
Meetings — 15 points maximum
Every meeting attended will equal 1 point
Elected Positions — 15 points maximum
Five points issued for maximum of three positions.
Each elected position or appointed means the following: line officers, executive officers, regular company officers, president, vice president, treasurer, assistant treasurer, secretary, members of LOSAP committee, active members of the banquet hall committee and Firemen Relief Association officers. Must complete the year term to qualify for points.
Miscellaneous — 20 point maximum
One point will be given for attendance at any fire company business, such as, but not limited to, the following:
Apparatus maintenance
Building and ground maintenance
Fund-raising
Parades
Memorial services
Attendance of state convention as a delegate or life member
Banquet hall activities (i.e., [but not limited to] bartending, working in kitchen, waiting on tables, Friday night grills, etc.)
Any other sanctioned fire company function officially approved by the Fire Company President and/or the Fire Company Fire Chief
LOSAP shall not provide for contributions for an active volunteer member's prior years of active emergency service prior to establishment of the LOSAP; however, as set forth in § 50-4F above, a member's active years of emergency service prior to the establishment of the LOSAP may be applied towards the member's eligibility for vesting.
