Municipally owned lands and buildings may be used by the public only during the hours posted at those locations and for the permitted activities.
The regulations governing the hours and use of the Township lands and buildings shall be duly promulgated by the Township Committee in the following manner:
A. 
Upon adoption by a majority vote of the full membership of the Township Committee, the regulations shall be filed with the Township Clerk and posted on the public bulletin board in the Municipal Building for not less than 10 days.
B. 
Said regulations shall be printed in the Township's official newspaper at least once not less than 10 days before they are to enter into effect.
C. 
Copies of the regulations shall be available to the public at the Municipal Building during regular business hours.
D. 
The hours of operation and the uses permitted shall be posted in accordance with § 246-1 above along with a notice as to how persons may obtain copy of the regulations.
E. 
Any amendment to the regulations shall be made in the same manner as the regulations themselves.
A. 
Posting, selling and soliciting or attempting to commit such acts without written consent of the Township Committee is prohibited.
B. 
Commercial enterprises or uses of all types are prohibited without written consent of the Township Committee.
C. 
No person shall allow a dog, cat or other animal to walk or run on any playing field or playing surface or to run at large.

Service and consumption prohibited; tailgating; exceptions.

(1) 
Neither the service nor consumption of alcoholic beverages of any kind shall be permitted on municipally owned land or in municipally owned buildings or structures. The Delaware Township Committee may, however, permit adults of legal drinking age, at sanctioned events with written authorization by the Delaware Township Committee, to tailgate, which shall be defined as permitting adults of legal drinking age to transport and consume alcoholic beverages, which shall be limited to beer or wine, at a Township-sanctioned event, and for such event, only on the specifically identified date(s), times and location(s), and subject also to the following:
(a) 
Adults of legal drinking age participating in tailgating must have valid identification on their person to exhibit to any inspecting authority or official.
(b) 
Adult participants of legal drinking age at such sanctioned events may not transport or consume any alcoholic beverage other than beer or wine.
(c) 
Under no circumstances shall any agent, servant or employee of the Township of Delaware or any public or private agency or auxiliary, including but not limited to: the fire department, police department, public works department and/or rescue squad, etc., affiliated or associated with the Township of Delaware, provide, disseminate, distribute and/or serve alcoholic beverages of any kind or nature to any person or party under any circumstance(s).
(d) 
Participants who tailgate at a Township-sanctioned event shall at all times observe and comply with the laws of the State of New Jersey, the ordinances of the Township of Delaware and any other federal, state or municipal rules or regulations.
(e) 
At no time shall the underage consumption of alcohol or providing, disseminating or distributing any alcoholic beverage to an underaged person, be permitted.
(f) 
It is specifically understood that Township-sanctioned events at which tailgating shall be permitted shall be subject to police inspection, and that on all occasions and under all circumstances, participants shall obey the directions and instructions given by any law enforcement officer.
(2) 
No participant, person or party shall consume alcoholic beverages to the point of intoxication. Any person visibly intoxicated or observed to be acting inappropriately, lewd or profane or otherwise observed under conditions or circumstances which may in the reasonable opinion of the inspecting authority give rise to the possibility of damage or injury to any third person or property, may be subject to expulsion from the event or other penalty as prescribed by law or ordinance.
E. 
No person shall engage in loud, boisterous, threatening, abusive, insulting or indecent language, or engage in any disorderly conduct or behavior tending to cause a breach of the public peace.
F. 
There shall be no dumping or littering. Groups are responsible for removing their own trash. Individual trash and litter from use of property must be placed in containers provided for that use.
G. 
No person shall throw, discharge or otherwise place or cause to be placed in the waters or streams any substance, matter or thing, either liquid or solid.
H. 
No person shall damage, deface, cut, carve, transplant or remove any tree or plant or injure the bark, or pick the flowers, fruits, berries or seeds of any tree or plant. Nor shall any person attach any rope, wire or other contrivance to any tree or plant. No person shall dig in or otherwise disturb grass areas or in any other way injure or impair the natural beauty or usefulness of any area. No person shall excavate, remove, add to or alter in any way any rock, soil, stone or sand.
I. 
No person shall mark, deface, disfigure, injure, tamper with, or displace or remove any building, bridge, table, bench, refuse container, fireplace, railing, paving or paving material, water line or other public utilities or parts or appurtenances thereof, sign, notice or placard, whether temporary or permanent, monument, stake, post or other boundary marker, or other structure or equipment, facilities or property or appurtenances whatsoever.
J. 
Open fires or any use of incendiary devices are prohibited without express permission by the Delaware Township Committee or the Delaware Township Recreation Commission.

K. 
Target practice of any kind is prohibited.
L. 
Horseback riding is only permitted in specifically designated and posted areas.
M. 
Horse carriage driving is prohibited.
N. 
The use of metal detectors and similar devices is prohibited without written consent of the Township Committee.
O. 
Hunting is prohibited by any person at any time using any weapon, including but not limited to rifle, shotgun, handgun, and bow and arrow.
P. 
No person shall enter any area designated as "Restricted" without written consent of the Township Committee.
Q. 
Picnicking is limited to those areas set aside and designated as picnic areas. Picnicking by groups of more than 20 people is only allowed by special permit from the Township Committee.
R. 
Camping is only allowed by special permit from the Township Committee.
S. 
Riding or walking a bicycle on any ball fields on Township park land is prohibited.
T. 
Parents, guardians or custodians are responsible for any violations of these regulations committed by a minor in their charge.
U. 
No person shall operate any motor vehicles on any established roads on municipal properties unless the motor vehicle is properly registered and displays proper registration plates. All motor vehicles are restricted to established park roads or to designated parking areas. The operation of any motorized vehicle including, but not limited to, snowmobiles, go-carts, all terrain vehicles, trail bikes, motorcycles or any off-road vehicles is prohibited.
V. 
The washing of automobiles is prohibited.
W. 
All golfing is prohibited.
X. 
Skateboarding and in-line skating is only permitted in specifically designated areas.
Y. 
No person shall make use of municipal properties and facilities contrary to posted or permitted instructions. The Township Police Department and/or any open space or recreational area personnel shall have the authority to eject from municipally owned land and buildings any person acting in violation of this article and shall have the authority to seize or confiscate and impound any item or device prohibited under this article or used in connection with any violation of this article.
Z. 
The Township Committee reserves the right to establish periodically by policy any fees and charges for entry, parking, use of facilities, and for other services, products, and uses. Proof of sufficient liability insurance coverage naming Delaware Township as an additional insured may be required by the Township Committee under certain circumstances.
AA. 
Any individual or group who violates any property regulation may be denied any future use of these facilities.
BB. 
Park hours; hours of operation. The Dilts Farm Park will be open from dawn to dusk. No unauthorized person shall enter upon or remain on the park lands except during its established hours of operation. Other municipal properties will be open to the public according to regularly established hours.
CC. 
The use of amusement rides, including inflatable and mechanical devices or any other mechanical device requiring generators or gas power is prohibited without express permission by the Delaware Township Committee or the Delaware Township Recreation Commission.

DD. 
Private and commercial hot air balloon operators are prohibited from taking off or landing at the Dilts Farm Park without express permission by the Delaware Township Committee or the Delaware Township Recreation Commission except in the case of an emergency.

EE. 
An official permit must be obtained and approved by the Delaware Township Committee or Delaware Township Recreation Commission for any legal fireworks display.

FF. 
Field usage by a group (defined as 10 persons or more) or an organization that utilizes the field/park four or more times in a calendar month must obtain a permit from the Township Committee.

GG. 
No dogs, except any guide, service and/or working dog in use pursuant to the New Jersey Law Against Discrimination, and no other domesticated animal shall be permitted at community events sponsored by Delaware Township, including, but not limited to, the Egg Hunt, Community Day, Fishing Derby, Dilts Farm Clean Up Day, and any such community event that may be identified by resolution of the Delaware Township Committee, except as otherwise expressly permitted by the Delaware Township Committee.

The following speed limit is hereby established for all vehicles within all open space and recreational areas of the Township: 15 miles per hour.
A. 
Permit applications may be obtained at Delaware Township Hall, Route 604, Sergeantsville, New Jersey 08557. To reserve a recreation area, facility or field, a certificate of insurance as proof of current liability coverage must be provided, except for individual users who shall execute a waiver of liability to the Township in lieu of providing a certificate, and such certificate shall include:
(1) 
Liability limits of $1,000,000 for each occurrence for personal injury and bodily injury/property damage.
(2) 
The certificate must indicate that athletic participation liability coverage is included for use of the Township facilities.
(3) 
Delaware Township must be specifically named as an additional insured.
(4) 
The certificate must indicate that the user's policies will be primary for the additional insured.
B. 
When a permit has been issued to a group that has reserved a facility, other people shall not be able to use that facility during the requested time.

Any person or group who violates or neglects to comply with any provision of this article or any regulation promulgated hereunder except as otherwise specified shall, upon conviction thereof, be punishable by a fine not to exceed $1,000 and/or by imprisonment for up to 90 days, and/or by a period of community service not exceeding 90 days, in the discretion of the court. Each and every day that such a violation continues shall be considered a separate and specific violation of this article.

This article permits the use of the paved parking lot at Dilts Farm Park under the conditions specified below by residents for safe recreational roller-skating, in-line roller-blading, roller hockey and skateboarding, hereafter "roller-skating activities."
The Recreation Committee designed the paved parking lot at Dilts Farm Park to permit the facility to serve either as a parking area or as a recreation area for roller-skating activities. The Commission selected a permeable paving medium of appropriate texture to provide adequate traction for skating. The design provides an obstruction free, smooth-surfaced space of a satisfactory size to accommodate roller-blade hockey.
The Township intends the paved lot primarily for parking by visitors to Dilts Farm Park; however, at some times, parking demands easily may be met without use of the lot. An authorized person shall close the gate at the entrance to the facility blocking vehicular access when it is not required for parking. Residents, wearing appropriate protective equipment, may skate in the lot when it is empty and the gate is closed.
Persons wishing to engage in roller-skating activities shall be responsible for wearing suitable protective equipment to prevent injury. As a minimum, without exclusion, they shall wear protective elbow and knee pads and acceptable protective headgear. The headgear must be a properly fitted and fastened helmet that meets or exceeds the standard of the American National Standards Institute (ANSI Z90.4 Bicycle Helmet Standard). Those wishing to participate in roller-blade hockey, in addition, shall wear protective gloves and, in the case of a goalie, protective leg pads, chest protector and cup. A goalie's helmet shall be equipped with a face shield.
Signs stating that protective equipment shall be worn and designating the minimum protective equipment to be used at the facility shall be posted at the entrance to the facility. Signs shall also state that roller-skating activities can only occur when the gate is closed.
Persons under the age of 13 years shall not use the facility unless supervised by an adult.
A person who violates the protective equipment section of this article first shall be warned of the violation by the enforcing official as designated by the Township Committee and, when said person is a minor, the parent or legal guardian of that person shall be notified of the violation. Subsequent offenses shall result in the loss of privilege to use the facility.
