This chapter shall be known as the "Uniform Construction Code Ordinance for Schuylkill Township."
Pursuant to the authority in the Pennsylvania Construction Code Act, 35 P.S. § 7210.501(a) and Title 34, Part XIV, Section 403.102(a) of the Pennsylvania Code, the Board of Supervisors of Schuylkill Township hereby adopt the Uniform Construction Code (UCC) and the International Codes incorporated therein as presently promulgated or as they shall be amended hereafter, except Chapter 405, Elevators and Other Lifting Devices, and except as hereafter set forth.
A. 
By electing to adopt, administer and enforce the Act, the Township hereby adopts and incorporates as fully set out at length herein the following codes published by the International Codes Council (ICC) as they shall be amended, supplemented, reissued, revised and its successor codes:

International Building Code, Chapters 2-29 and 31-35, with Appendixes E, H and I.
(2) 
International Residential Code, with Appendixes A through H, J and O.
(3) 
International Fire Code, with Appendixes C and D.
(4) 
International Mechanical Code.
(5) 
International Plumbing Code, with Appendixes C, E and G.
(6) 
International Fuel Gas Code, with Appendix A.
(7) 
International Energy Conservation Code.
(8) 
International Existing Building Code, with Appendixes A, B and Resource A.
(9) 
International Performance Code.
(10) 
International Wildland Urban Interface Code, with Appendixes A, B and C.
(11) 
NFPA 70, National Electric Code.
(12) 
ANSI A117.1, Accessible and Usable Buildings and Facilities.
B. 
Additions, insertions and amendments to the adopted codes. This section makes amendments to the technical provisions of the 2003 International Codes incorporated by reference and to each such International Code as may be promulgated in the future.
(1) 
The following sections of the IBC 2009 are hereby amended and revised as follows:
Section 903.2.1.1 Group A-1: in number 1, insert 7,500 in place of 12,000.
Section 903.2.1.3 Group A-3: in number 1, insert 7,500 in place of 12,000.
Section 903.2.1.4 Group A-4: in number 1, insert 7,500 in place of 12,000.
Section 903.2.2 Group E: in number 1, insert 7,500 in place of 20,000.
Section 903.2.3 Group F-1: in number 1, insert 7,500 in place of 12,000.
Section 903.2.3: add Group F-2, to read as follows: An automatic fire sprinkler system shall be provided throughout all buildings containing Group F-2 occupancies where the Group F-2 fire area exceeds 7,500 square feet.
Section 903.2.6 Group M: in number 1, insert 7,500 in place of 12,000.
Section 903.2.8 Group S-1: in number 1, insert 7,500 in place of 12,000.
Section 903.2.8 is amended by adding Group S-2, to read as follows: An automatic fire sprinkler system shall be provided throughout all buildings containing Group S-2 occupancies where a Group S-2 fire area exceeds 7,500 square feet.
Section 903.2 is amended by adding the following new subsection:
903.2.14 Group B. An automatic sprinkler system shall be provided for Group B occupancies where one of the following conditions exist:

The fire area exceeds 7,500 square feet.
2.
The building is three or more stories in height.
Section 903.4, Sprinkler System Monitoring and Alarms, is amended by adding the following:
This section shall include all new and existing automatic fire sprinkler systems, both required and nonrequired.
Section 907.14, Monitoring, is amended by adding the following sentence:
This section shall include new and existing fire alarm systems, both required and nonrequired, fire alarm and detection systems.
Section 907.15, Automatic Telephone-Dialing Devices, is deleted in its entirety.
Section 1023, Exit Discharge, is amended by adding the following:
Safe exit discharge shall include snow/ice guards on the roof of the structure when deemed necessary by the Building Code Official.
Section 1608.1, Snow Loads, General, is deleted in its entirety and replaced as follows:
Design snow loads shall be determined in accordance with this section or shall comply with section 7 of ASCE listed in Referenced Standards chapter. The design snow loads shall be determined by Section 1608.2, but no less than 30 pounds per square foot.
Section 1612.3, Establishment of flood hazard areas. Insert: Schuylkill Township.

Appendix H 101.1, General, is amended by adding the following sentence: The Schuylkill Township Zoning Ordinance shall regulate all matters pertaining to type of signs, location of signs, number of signs, area of signs, and height of signs.
Appendix H 101.2 Signs Exempt from Permits, is deleted in its entirety.
Appendix H 108, Animated Devices, is deleted in its entirety.
Appendix H 110, Roof Signs, is deleted in its entirety.
Appendix H 112, Projecting Signs, is deleted in its entirety.
Appendix H 113, Marquis Signs, is deleted in its entirety.
Appendix H 114, Portable Signs, is deleted in its entirety.

The following sections of the International Residential Code 2009 are hereby amended and revised as follows:
Section R101.1, Title: Insert: Schuylkill Township
Section R202, Definitions:
"Building sewer" is amended by adding the following: All matters related to the building sewer design, installation, inspection, testing, and repair of building sewer system shall be in accordance with the rules and regulations set forth by the sewer authority having jurisdiction or on-lot sewage disposal systems shall comply with the Pennsylvania Sewage Facilities Act 537.
Table R 301.2(1), Climatic and Geographic Design Criteria, shall read as follows:
Ground snow load: 30 PSF.
Wind speed: 90 mph.
Seismic design: Category B.
Weathering: Severe.
Frost line depth: 36 inches.
Termites: Moderate to heavy.
Decay: Slight to moderate.
Winter design temperature: 14°.
Ice shield underlayment: Yes.
Flood hazards: Schuylkill Township Zoning Ordinance — Flood Hazard District.
Air freezing index: 689.
Mean annual temperature: 53.1°.
Section R403.1, Footings, is amended by adding the following:
When unsuitable soil conditions are present or if blasting is required in the excavation of footings and foundation, two #4 diameter reinforcing bars are required to be installed in the entire footing.
If conditions warrant, a design professional shall be consulted for footing/foundation design.
Section R403.1.1, Footings Minimum Size, is amended as follows: Insert "8" inches in place of "6" in the third sentence.
Section R405.1, Foundation Drainage, is amended by adding the following new subsection:
Section R405.1.1, Sump Pump Discharge Piping Termination. Sump pump discharge piping shall terminate at least five feet beyond the exterior foundation wall, but no closer than 10 feet from a property line or the street right-of-way.
Section P2602.1 is amended to add the following sentences:
All on-lot sewage disposal systems shall comply with the Pennsylvania Sewage Facilities Act 537 and shall be inspected and approved by the Chester County Health Department.
In existing structures, an approved inspection company shall verify that the on-lot sewage disposal system properly operates in accordance with DEP regulations prior to the issuance of any building permit. Noted deficiencies shall be corrected within 30 days and approved by the Chester County Health Department.
Section P2603.6, Freezing, is amended by deleting the last sentence and inserting in its place:
Water service pipe shall be installed a minimum of 36 inches below finished grade.
Section P2603.6.1, Sewer Depth. Delete in its entirety and replace with:
Building sewers that connect to private sewage disposal systems shall be a minimum depth below finished grade at the point of septic tank connection which complies with the Schuylkill Township SALDO[1] and the requirements of the Chester County Health Department. Building sewers shall be a minimum depth below finished grade, as required by the sewer authority having jurisdiction.
Section P2903.10, Hose Bibb, is deleted in its entirety and replaced with the following (exception remains):
Hose bibbs subject to freezing, including the "frost-proof" type, shall be equipped with an accessible stop-and-waste-type valve inside the building, so that they can be controlled and/or drained during cold periods, and with an atmospheric vacuum breaker.

Section 108.0, Board of Appeals, is deleted and replaced with the provisions of the Uniform Construction Code relating to boards of appeals, as amended.
Section 109.3, Violation Penalties. Insert: Summary Offense, $1,000, 30 days.
Section 111.4, Failure to comply. Insert: $100, $1,000.
Section 307.1.1, Prohibited Open Burning, is amended by adding the following:
Refuse, leaves and trimmings shall not be burned outdoors on the premises in any manner whatsoever.
Section 903.2.1.1, Group A-1. In number 1, insert 7,500 in place of 12,000.
Section 903.2.1.3, Group A-3. In number 1, insert 7,500 in place of 12,000.
Section 903.2.1.4 Group A-4. In number 1, insert 7,500 in place of 12,000.
Section 903.2.2 Group E. In number 1, insert 7,500 in place of 20,000.
Section 903.2.3 Group F-1. In number 1, insert 7,500 in place of 12,000.
Section 903.2.3: Add Group F-2, to read as follows: An automatic fire sprinkler system shall be provided throughout all buildings containing Group F-2 occupancies where a Group F-2 fire area exceeds 7,500 square feet.
Section 903.2.6, Group M. In number 1, insert 7,500 in place of 12,000.

Section 903.4, Sprinkler System Monitoring and Alarms, is amended by adding the following:
This section shall include all new and existing automatic fire sprinkler systems, both required and non-required.
Section 907.14, Monitoring, is amended by adding the following sentence:
This section shall include new and existing fire alarm systems, both required and nonrequired, fire alarm and detection systems.
Section 907.15, Automatic Telephone-Dialing Devices, is deleted in its entirety.
Section 1023, Exit Discharge, is amended by adding the following:
Safe exit discharge shall include snow/ice guards on the roof of the structure when deemed necessary by the Building Code Official.
Section 3301.2.4.1, Blasting, is amended by adding the following:
Before a fire permit is issued for blasting, the permit applicant shall provide evidence of a current blasting license from the Commonwealth of Pennsylvania and shall pay the required fee. The application shall also provide a valid certificate of insurance showing liability coverage for the blasting operation of not less than $1,000,000.
Section 3301.2.4.2, Fireworks Display, is amended to include the following sentence: The permit applicant shall submit the hold harmless agreement executed with Schuylkill Township, evidence of current workers compensation insurance, DOT insurance, and general liability insurance and umbrella insurance.
Section 3404.2.9.6.1 (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited):
Prohibited within the R-1, R-2, APO, APO I, APO II, NO, A-R, F and NC Zoning Districts. Permitted in all other zoning districts; provided that quantities, protective devices and location of such storage comply with Section 3404.2.9.6.
Section 3406.2.4.4 (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks is prohibited):
Prohibited within the R-1, R-2, APO, APO I, APO II, NO, A-R, F and NC Zoning Districts. Permitted only within the FR, C, LI, I and I/LI Zoning Districts, provided that tank capacities, protection devices and location of such storage comply with Section 3406.2.
Section 3506.2 (geographic limits in which the storage of flammable cryogenic fluids in stationary containers is prohibited):
Permitted only within the LI, I and I/LI Zoning Districts, provided that quantities, protective devices and location of such storage complies with Section 3506.
Section 3804.2 (geographic limits in which the storage of liquefied petroleum gas is restricted for the protection of heavily populated or congested areas):
Permitted within all zoning districts, provided that quantities, protective devices and location of such storage complies with Section 3804.

The following sections of the International Mechanical Code 2009 are hereby amended and revised as follows:

Section 202, Definitions:

Section 305.6.1, Sewer Depth. Delete in its entirety and replace with:
Building sewers that connect to private sewage disposal systems shall be a minimum depth below finished grade at the point of septic tank connection which complies with the Schuylkill Township SALDO and the requirements of the Chester County Health Department. Section 608.15.4.2, Hose Connections, is amended by adding the following:
Wall hydrants installed on the exterior of the building or other locations subject to freezing shall be automatic draining, freezeless wall faucets.
Section 701.2, Sewer Required, is amended as follows:
Replace "where available" in the third line with "when required by Township ordinance."
Replace "International Private Sewage Disposal Code" with the following: Pennsylvania Sewage Facilities Act 537 and shall be inspected and approved by the Chester County Health Department. In existing structures, an approved inspection company shall verify that the on-lot sewage disposal system properly operates in accordance with DEP regulations prior to the issuance of any building permit. Section 803, Special Wastes, is amended by adding a new subsection that reads:
Section 803.4, Requirements: The sewer authority having jurisdiction shall be consulted prior to the discharge of special waste.
Section 904.1, Roof Extension: Insert: 12" minimum.
Section 1113, Sumps, is amended by adding the following subsection:
Section 1113.3.5, Sump Pump Discharge Piping Termination: Discharge piping termination shall terminate at least 5 feet beyond the exterior side of the building foundation wall, but no closer than 10 feet from a property line or the street right-of-way line.

Section 109.4.7, Violation penalties, insert: Summary offense, $1,000, 30 days
Section 114.4, Failure to comply, insert: $100, $1,000.
The Building Code shall be administered and enforced by the Building Code Official who shall be appointed by resolution of the Board of Supervisors.
Pursuant to Section 104(d)(1) of the Act, all building code ordinances or other code ordinances or portions of ordinances which were adopted by Schuylkill Township on or before July 1, 1999, and which equal or exceed the requirements of the UCC and the model codes published by the International Codes Council incorporated therein shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the UCC or the model codes published by the International Codes Council incorporated therein, as amended from time to time.
Section 403.102(1)(8) of the regulations allows a municipality to revise certain provisions in the regulations regarding the administration and enforcement of the Act. Pursuant to such authority, Schuylkill Township elects to make the following revisions to the regulations:
A. 
Section 403.42(a) is amended by the addition of the following: On a form obtained from the Zoning Administrative Officer with the applicable permit fee.
B. 
Section 403.42(b) is amended by the addition of the following: By submitting an application for a permit, the applicant authorizes the Building Code Official to enter any structure or premises at any reasonable time to inspect for compliance with the UCC and this article.
C. 
Section 403.43(a) is amended by the addition of the following: When a permit application is submitted for any historic building or structure, which is identified and classified as an historic structure by the federal or local government authority or the Historical and Museum Commission as an historic building, the Building Code Official shall grant or deny a the permit application, in whole or in part, within 60 business days of the filing date.
D. 
Section 403.45, Inspections, is hereby amended by the addition of subparagraph (f) as follows: (f) Reinspections: When a structure or equipment or mechanical, electrical or plumbing or other system subject to inspection under this or any other code shall fail an inspection or when the Building Code Official is contacted to perform a test or inspection but the structure, equipment or system is not ready for testing or inspection when the Code Official arrives, the contractor or other person or business responsible for performing the work shall pay a fine for each such failure, as prescribed from time to time by resolution, before the inspection shall be rescheduled.
E. 
The exemption in Section 403.62(c)(1)(xvii) shall be deleted. The Township shall require a building permit for the installation of all decks.
F. 
Section 403.83 is amended by the addition of the following:
If an order from the Board of Appeals or an order or notice of violation from the Building Code Official or a Construction Code Official is not complied with within the time stated therein, the Township may institute proceedings before a Magisterial District Judge for failure to comply therewith.
Any person, firm or corporation or other business entity found guilty of violating any order issued pursuant to the UCC or this article shall be subject to pay a fine not exceeding $1,000 plus costs. Each day's violation will constitute a separate offense.
Nothing contained in this section or any other section of the UCC or this article shall prohibit Schuylkill Township from seeking an injunction or any other legal remedy to enforce its stop-work orders, its notices of violation, its orders to show cause or to vacate, or its notices of unsafe building, structure or equipment.
