A.Â
This article sets forth uniform requirements for Schuylkill Township
users of the Valley Forge Sewer Authority Sewage Treatment Plant.
B.Â
It is Schuylkill Township's intent that this article provide
for the enforcement of the various regulations promulgated by the
Valley Forge Sewer Authority, the United States Environmental Protection
Agency, the Pennsylvania Department of Environmental Protection, and
such other agencies which may succeed the aforementioned agencies.

It is the specific intent of this article to provide the means of
enforcement of the pretreatment standards promulgated by the United
States Environmental Protection Agency as set forth in 40 CFR 403
et seq. (1983) pursuant to the Clean Water Act, as amended, 33 U.S.C.
§ 1251 et seq.
The Valley Forge Sewer Authority Rules and Regulations Governing
the Acceptance of Industrial Wastes, as may be amended or supplemented
from time to time, shall be minimum regulations and shall apply uniformly
to each User located in Schuylkill Township.

The Board of Supervisors of Schuylkill Township hereby ordains and
establishes that any person who fails or refuses to comply with the
Valley Forge Sewer Authority Rules and Regulations, as amended, which
are incorporated herein by reference and attached hereto as Appendix
A,[1] shall be subject to the penalties set forth in this article.

If any person discharges sanitary sewage, industrial waste or other
wastes into the Valley Forge Sewer Authority Sewage Treatment Plant
contrary to the provisions of this article, any industrial permit
requirements, or national categorical pretreatment standards, or any
order of Schuylkill Township, the Township Solicitor may commence
an action for appropriate legal and/or equitable relief in the Court
of Common Pleas of Chester County.

Any person who shall violate any provision of this article shall,
upon conviction thereof, be sentenced to pay a fine of not more than
$1,000, and/or to imprisonment for a term not to exceed 90 days. Every
day that a violation of this article continues shall constitute a
separate offense.[1]
B.Â
Any person who knowingly makes any false statements, representation,
or certification in any application, record, reports, plan, or other
document filed or required to be maintained pursuant to this article,
or industrial waste permit, or who falsifies, tampers with, or knowingly
renders inaccurate any monitoring device or method required under
this article, shall be prosecuted in accordance with the provisions
of the Pennsylvania Crimes Code pertaining to perjury and falsification
in official matters, 18 Pa.C.S.A. § 4901 et seq.
