No water shall be provided for internal or external use to any residential, commercial, industrial, agricultural, recreational, governmental, or public building or structure of any kind which is constructed or remodeled and in which plumbing, water piping or water fixtures are to be installed, extended or altered in any way, and for which construction a permit is required to be obtained from Schuylkill Township (or would be required but for an exemption from a permit requirement for public or governmental agencies) unless the new, extended or altered plumbing, water piping and other water using fixtures therein conform to the requirements and standards of § 351-2 of this article. The provisions of this article shall apply to any such building or structure for which such a building permit is issued, or would otherwise be required to be issued but for such an exemption, on or after May 6, 1992.
A.
Water closets and associated flushing mechanisms. The water consumption
of water closets shall not exceed an average of 1.6 gallons per flush
cycle over a range of test pressures from 20 to 80 psi. The fixture
shall perform in accordance with the test requirements of the ANSI
A112.19.2M and ANSI A112.19.6M.
B.
Urinals and associated flushing mechanisms. Urinal water consumption
shall not exceed an average of 1.5 gallons per flush cycle over a
range of test pressures from 20 to 80 psi. The fixtures shall perform
in accordance with the test requirements of ANSI A112.19.2M and ANSI
A112.19.6M.
C.
Showerheads. Showerhead discharge rates shall not exceed 3.0 gallons
of water per minute over a range of test pressures from 20 to 80 psi.
The fixture shall perform in accordance with the test requirements
of ANSI A112.18.1M.
D.
Faucets. Sink and lavatory faucet discharge rates shall not exceed
3.0 gallons of water per minute over a range of test pressures from
20 to 80 psi. The fixture shall perform in accordance with the test
requirements of ANSI A112.18.1M.
A.
Special purpose equipment. The performance standards of § 351-2 shall not apply to fixtures and fittings such as emergency showers, aspirator faucets, and blowout fixtures that, in order to perform a specialized function, cannot meet the specified standards.
B.
Exemptions. Any person(s) may apply to the Schuylkill Township Board
of Supervisors for an exemption to the terms of this article, which
may be granted by the Board of Supervisors, upon proof that some other
device, system or procedure will save as much or more water as those
set forth herein, or that those set forth herein cannot be complied
with, without undue hardship.
The Board of Supervisors may, from time to time, modify, add
to, or remove from the standards and restrictions herein.
It shall be a misdemeanor for any person to use or apply water
within Schuylkill Township contrary to or in violation of the restrictions
herein, and, upon conviction thereof, such persons may be punished
by being imprisoned in the county jail for not more than 30 days or
by fine of not more than $1,000, or by both such fine and imprisonment.

All owners of the specific improved properties listed herein
below abutting the South Second Avenue Water Supply Replacement Project
intended for dedication to Philadelphia Suburban Water of Pennsylvania
are required to make connection with the water system. The specific
properties required to make connection with the water system are listed
below by address and tax parcel:

Notice of the requirement to connect to such water supply system shall be given to the property owner in § 351-6 above either by personal service or by registered mail.
All wells located on any property served by said water system
shall be abandoned in accordance with the terms of this article and
applicable law upon the date of connection of the building served
to the water system, except as provided herein below. The owners of
specific properties may retain their existing well upon the written
concurrence of the Chester County Health Department and Philadelphia
Suburban Water Company of Pennsylvania and subject to full compliance
with any condition that may be imposed by the Health Department or
Philadelphia Suburban Water Company on retaining use of the well notwithstanding
the connection to the water system.
Any property owner properly notified as in § 351-7 above who should refuse or neglect to allow the connection with said water system and/or the well abandonment for a period of 90 days after service of notice shall be in violation of this article.
In the event that an owner of a property shall neglect or refuse
to allow the connection with said water system and/or the well abandonment
for a period of 90 days after notice, the Board of Supervisors or
its agents may enter upon said property owner's property and
construct such connection and/or cause such abandonment.
No person shall maliciously, willfully or negligently damage,
destroy, deface, block or otherwise tamper with any water main or
other structure or equipment that is part of the water supply system.
Any person violating this section shall be in violation of this article.
Any person who violates or fails to comply with any of the requirements
of this article, in addition to any other remedy available under law
or equity, shall be subject to a criminal fine in the amount of at
least $25, but not to exceed $1,000, or suffer imprisonment for a
period of not more than 30 days, or both, together with the costs
of prosecution. Each twenty-four-hour period during which failure
to comply continues shall constitute a separate offense. Enforcement
of this article shall be by action brought before a Magisterial District
Judge in the same manner provided for the enforcement of summary offenses
under the Pennsylvania Rules of Criminal Procedure. The Township Solicitor
may assume charge of the prosecution without the consent of the District
Attorney. All fines and penalties collected for the violation of this
article shall be paid over to the Township treasury.
