in its entirety 5-3-2017 by L.L. No. 2-2017. Subsequent amendments
noted where applicable.]
The Town Board of the Town of Saugerties, New York, hereby finds
and determines that public safety and the costs of maintenance require
that the use of Town parks and other facilities be made subject to
the following rules and regulations.
This chapter governs the use of all parks and other facilities
owned by, operated by or subject to the control and supervision of
the Town of Saugerties or any municipal body or agency thereof. This
includes, but is not limited to, Town Hall and other offices, the
Highway Garage, the Cantine/Veterans Memorial Complex, the Frank D.
Greco Memorial Multi-Purpose Building, the Glasco Little League Complex,
Jaycee Field, Mt. Marion Park, Bigelow Park, Twin Maple Parks Circles,
Glasco Minipark and George Terpening Sr. Memorial Minipark, the sewer
treatment plants and the municipal transfer station.
A.
Town offices are open only during regularly scheduled business hours,
with the exception of the Police Department, which is open 24 hours
a day.
B.
The Frank D. Greco Memorial Multi-Purpose Building is open for use
from 7:30 a.m. through 11:00 p.m. Prior to 4:00 p.m. on weekdays,
senior citizen uses have priority. At other times it is available
to be used by advanced reservation, along with payment of applicable
facility use fee.
C.
Town parks are open from 7:30 a.m. through sunset with the exception
of the Cantine/Veterans Memorial Complex, which is open from 7:30
a.m. through 11:00 p.m. Provided there are evening games and/or other
activities taking place at the Glasco Little League Complex, that
facility shall remain open past sunset until games and/or activities
are complete, however, no later than 11:00 p.m. Some facilities within
the Cantine/Veterans Memorial Complex and the Glasco Little League
Complex, such as, but not limited to, the Small World Playground and
the Kiwanis Ice Arena may only be used during the hours posted at
those facilities.
D.
Opening and closing times are subject to change and both opening and closing hours can be extended to accommodate special events and activities. There are no set opening and closing times at the Kiwanis Ice Arena, which is open and operated dictated on games, tournaments, activities and other related events. Exceptions to sections of Chapter 224 will be allowed for special events and activities such as, but not limited to, dog shows and training, firearms shows, fireworks, auto shows, twenty-four-hour marathons, festivals, special events that either start prior to and/or end after regular closing times, etc. Events and special activities will be granted, provided the proper permits are obtained and authorized from the Town of Saugerties and any other applicable permit agency.
E.
It is unlawful to be using a facility outside of its posted hours
or to be within a Town facility when it is not open, except for employees
of the Town who have responsibilities within that facility or except
with prior permission from the Town of Saugerties.
Baseball fields are to be used for baseball only. Softball fields
are to be used for softball only. Dugouts and stands are to be used
primarily for baseball and softball related; soccer fields are to
be used primarily for soccer; basketball courts are to be used primarily
for basketball; and tennis courts are to be used primarily for tennis.
It is unlawful to use any of these facilities and/or any other facilities
in a manner which causes destruction to that facility. It is unlawful
to use any facility for other than its stated purpose unless prior
authorization is requested and approved. No metal-detecting is allowed
on any baseball, softball or soccer fields unless exception is granted
by the Parks and Buildings Department. Metal-detecting is permitted
in turf areas off of the fields; however, the Parks and Buildings
Department must first be advised, prior to the detecting. When so
authorized, grounds and turf must be restored to the condition as
found prior to detecting/probing.
No person shall suffer, allow or permit any pet or other animal
kept, controlled, harbored or otherwise maintained or played with,
whether the animal is owned or not and whether the animal is a pet,
domestic or wild or semi-wild animal, or a dog, cat or any other type
of animal, to enter, use or remain upon any of the parks or other
facilities which are subject to this chapter. This includes, but is
not limited to, Town Hall and other offices, the Highway Garage, the
Cantine/Veterans Memorial Complex, the Frank D. Greco Memorial Multi-Purpose
Building, the Glasco Little League Complex, Jaycee Field, Mount Marion
Park, Bigelow Park, Twin Maple Parks Circles, Glasco and George Terpening
Sr. Memorial Miniparks, sewerage treatment plants and the municipal
transfer station. This prohibition shall not apply to licensed service
dogs or licensed guide dogs for the deaf, blind or other persons with
medical conditions.
No bicycles, skateboards, roller skates, roller blades or similar
devices are permitted on any baseball, softball or soccer field, tennis
or basketball court, in a pavilion or building, or on any ice-skating
rink or playground.
A.
It is unlawful to bring garbage and litter to a Town facility, park
or office and dispose of it there. Where garbage and litter receptacle
containers are provided, they are only to be used for the deposit
of garbage and litter generated from the current use of the Town facility,
park or office. It is unlawful for any person to sweep, throw, cast,
drop, put or place or, having accidentally dropped, to fail to pick
up any bag, bottle, bottle cap, box, container, garbage, paper, piece
of paper, wrapper, or any other trash or litter in or upon any Town
facility, park or office except in a receptacle provided for such
purpose, or to permit any person under his or her control or employ
to do the same.
B.
Likewise, per aforementioned, the same applies to recycling.
C.
Where and/or when it is deemed detrimental by any department head,
the Police Chief or designee(s), and in order to maintain a clean,
safe and sanitary environment, restrictions may be placed on the use
of certain consumables such as, but not limited to, sunflower seeds,
peanut shells, food, liquids, glass containers, etc., in or on certain
facilities such as, but not limited to, dugouts, VIP seating, ice
rink sheet, pavilions, skate park, etc.
It is unlawful to consume alcoholic beverages at a Town facility,
park or office unless a permit has been authorized by the Town Clerk
or designee or authorized representative of the Parks and Buildings
Department. If a permit has been issued, it must be conspicuously
posted at the location where the alcoholic beverages are being distributed.
A fee in an amount determined from time to time by resolution of the
Town Board will be required for the issuance of a permit. A permit
will only be issued in conjunction with a facilities or pavilion permit
and will authorize the consumption of alcoholic beverages only in
the area stated on the permit. This permit is subject to being forfeited
in the event that the consumers of the alcoholic beverages, in the
opinion of an employee of the Parks and Recreation Department or an
employee of the Town police or park security personnel, cause inconvenience
or annoyance to other users of the facility or misuse the facility.
Sales of alcoholic beverages require additional application to the
New York State Alcoholic Beverage Control Board (NYS ABC Board), along
with prior authorization from the Superintendent of Parks and Buildings
and, in some cases, the Chief of Police and the Town Board. Once a
State ABC permit is issued, consumption of alcoholic beverages must
be confined to the designated area as depicted on the State ABC application,
along with any other stipulation contained in said permit.
A.
The maximum speed limit within all parks is 15 miles per hour, and
it is unlawful to exceed that limit in a motor vehicle.
B.
All motor vehicles, including all-terrain vehicles and recreational
motor vehicles, must remain on the roadways and parking areas. It
is unlawful for any such vehicle to be on any grassy area, any baseball,
softball field or soccer field, tennis or basketball court, skate
park, trails or within a pavilion, unless prior written authorization
has been granted.
C.
Parking on or on either side of Court Drive within the Cantine/Veterans
Memorial Complex, which goes from Washington Avenue near the tennis
courts west to and intersects with Pavilion Street adjacent to the
Kiwanis band stage, is prohibited.
D.
Parking within fire lanes adjacent to pavilions and other buildings
and in violation of posted handicap signs is prohibited.
E.
Blocking emergency access zones as posted and marked on the pavement
is prohibited.
F.
Parking in front of or adjacent to any gate is prohibited.
G.
The use of the service and emergency access roadways and drives within
the Cantine/Veterans Memorial Complex without authorization is prohibited.
This includes, but is not limited to, the service drives from Pavilion
Street to Teddy Lorenz Jr. Memorial Field #9, Pavilion Street to West
Field #7 and Field #8, Pavilion Street to Jack Keeley Memorial Field
#10 and the Tennis Court parking lot, Court Drive to Jack Keeley Memorial
Field #10 and the west side of the tennis courts.
H.
Parking is prohibited in violation of any posted sign. The Superintendent
of Parks and Buildings or his or her representative, or the Chief
of Police or his representative, or the Highway Superintendent or
his representative are authorized to post signs restricting parking
in areas of the parks as the need from time to time arises.
I.
In addition to the other penalties as provided in this chapter, a
vehicle parked in violation of this chapter is subject to being towed
at the owner's or operator's expense.
J.
Through traffic is prohibited from using the roadways within the
Town's parks.
K.
Parking at any Town facility, park or office is at the risk of the
owner or operator, even if the Town charges a fee for the parking.
L.
All roadways, service drives are subject to closure to accommodate
special activities, festivals and other events, along with maintenance
work.
M.
Traffic control devices may be implemented at any time to accommodate
festivals, activities, events, maintenance, etc., including, but not
limited to, road barricades, pedestrian barriers and the like, to
ensure both public and staff safety.
N.
Per previously approved Board Resolution of September 18, 1996, authorized
installed "Stop" signs must be adhered to at intersections, within
the Cantine Veterans Memorial Complex, as follows:

A.
Tennis courts may not be reserved except by the high school tennis
team or approved league or tournament play. When so reserved, at least
one court must be left open for public usage. Tennis players must
limit play to one hour when others are waiting to use the courts.
B.
The Frank D. Greco Memorial Multi-Purpose Building and the large
and small pavilions may be reserved by applying to the Town Clerk
or the Parks and Buildings Department and completing an application
for use, in advance. A fee in an amount determined from time to time
by resolution of the Town Board will be required for the issuance
of a permit and may include a refundable security deposit. The issuance
of a permit may be conditioned on the applicant agreeing to be responsible
for any damage which may occur at the facility and for its cleanup,
along with other regulations specific to the facility being utilized
and may be conditioned on the applicant providing insurance coverage
and liability releases or hold harmless agreement. Permits shall be
conspicuously posted at the facility.
C.
Baseball, softball and soccer fields, basketball courts, band stage, all other pavilions not referenced in Subsection B, portions of the complex or its entirety, satellite parks, the ice arena, and all other facilities may be reserved by completing an application, in advance, obtainable through the Parks and Buildings Department or, in the case of the ice arena, through the Ice Arena Director or designee. A fee in an amount determined from time to time by resolution of the Town Board will be required for the issuance of a permit and may include a refundable security deposit. The issuance of a permit may be conditioned on the applicant agreeing to be responsible for any damage which may occur at the facility and for its cleanup, along with other regulations specific to the facility being utilized and may be conditioned on the applicant providing insurance coverage and liability releases or hold harmless agreement. Permits shall be conspicuously posted at the facility.
D.
Some facilities may only be used by obtaining an authorized permit
and are not available for general public use such as, but limited
to, press boxes, concession buildings, Cantine Field #11, Kiwanis
Band Stage, etc. Some facility components or amenities on certain
fields or facilities may not be available for use under a general
field and/or facility use permit, unless the applicant requests and
agrees to take responsibility and reimburse for any damage(s), lost
product(s) and other related. Some of these include, but are not limited
to, scoreboards, concessions, press boxes, VIP seating, public address
systems, audio and video equipment. Upon authorization, there may
be an additional use fee, along with additional refundable security
deposit.
E.
If field lighting is required, it must be requested at the time of
application submittal. A field lighting surcharge in an amount determined
from time to time by resolution of the Town Board is required. When
inclement weather delays games, tournaments, etc., and lighting is
required, it will be granted with the stipulation of payment of field
lighting surcharge.
F.
Requests for reservations likely to involve more than 250 people
or for activities of a commercial nature, such as a circus, auto show,
tournament, flea market, musical event, festival or similar event,
may be subject to reimbursement to the Town for its additional expenses,
including, but not limited to, additional staff-power and overtime,
security and utilities. Any such request is subject to being denied
if it is not made more than 120 days in advance of the event. It is
highly recommended for all other smaller reservations, requests are
made in as much advance as possible.
G.
It is unlawful to use a facility while it has been reserved by another.
H.
When a field and/or facility is posted closed, or gates or doors
are locked, no access is permitted and it is unlawful to be utilizing.
I.
Cancellations due to weather, other related field and surface conditions,
along with acts of God are determined by designated Parks and Buildings
staff. As much advance notice as possible will be given. Parks and
Buildings staff also make determination on rain (weather) delays and
postponements, in conjunction with umpires or officials.
J.
Any organization running its respective leagues would open the concession
only when their specific league is utilizing the field(s) and playing/hosting
games related to their specific league. The only exception to this
would be when an "outside" organization does not run a concession
of their own and asks the league to open their concession.
A.
The parks of the Town of Saugerties, including the Cantine/Veterans
Memorial Complex, have been constructed and are maintained primarily
for community recreational use.
B.
Any activity which, in the opinion of an employee of the Parks and
Recreation Department or an employee of the Town police or park security
personnel, is likely to cause inconvenience or annoyance to other
users of the facility or is detrimental to or a misuse of the facility
subjects that person to the forfeiture of his or her right to enjoy
the privileges of the parks.
C.
Good sportsmanship is expected from all players, teams, coaches and
spectators. Use of profanity, throwing of bats, helmets, sticks, pucks
and other items and equipment, along with argumentative behavior towards
staff personnel or umpires, officials, score-keepers, and others in
attendance or present or any other unsportsmanlike behavior is not
permitted and may result in ejection from the facility.
D.
In the event that, in the opinion of an employee of the Parks and
Recreation Department or an employee of the Town police or park security
personnel, a person(s) is engaging in such behavior, these Town personnel
may direct that person(s) to immediately leave the park, and that
person may not return to the park for at least 24 hours. These Town
personnel may impose a greater loss of privileges than 24 hours. A
penalty greater than 24 hours may be appealed to the head of the department
of the person who imposed the forfeiture together with the Town Board
member who is the liaison to that department and the Supervisor. It
is unlawful to be within a Town Park while that person's privilege
to do so has been revoked.
E.
The Cantine Veterans Complex and all satellite parks are all smoke-
and drug-free facilities. Smoking and the use of any tobacco products
and drugs, along with related paraphernalia, is prohibited and unlawful.
Any person convicted of a violation of any of the provisions
of this chapter shall be guilty of a violation and shall be punished
by a fine of not less than $25 but no more than $250 or by imprisonment
of not more than 15 days, or both.
