For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
CHURCH
Any duly recognized house of worship which qualifies for exemption from taxation.
ISSUING AUTHORITY
The Township Council.
LICENSED PREMISES
Any premises licensed for the sale of alcoholic beverages.
LICENSE FOR THE SALE OF ALCOHOLIC BEVERAGES
All plenary retail consumption licenses, plenary retail distribution licenses, club licenses and plenary retail consumption licenses issued to restaurants.
PRIVATE SCHOOLHOUSE
All schools conducted by a duly recognized church or society not for pecuniary profit.
PUBLIC PLAYGROUND AND RECREATION AREA OR BUILDING
All areas owned by the Township and designated by proper action of the Township Council as an area or building for the recreation of the children of the community.
PUBLIC SCHOOLHOUSE
All buildings operated by the Board of Education of the Township and attended by children.

(a) 
The number of liquor licenses for the Glenpointe area, known and designated as the land in RC-1, RC-2, and RC-3 Zones on the Zoning Map of the Township of Teaneck, shall not exceed four, including hotel licenses.

(a) 
No license for the sale of alcoholic beverages shall be granted, issued or transferred to any premises which are situated within 200 feet of any church or public or private schoolhouse, public playground or public recreation area or building.
(b) 
The provisions of § 4-8, Minimum distance from churches, schoolhouses, etc., of the Township Code shall not apply to licensees in the Glenpointe area, known as the land in RC-1, RC-2 and RC-3 Zones on the Zoning Map of the Township of Teaneck.

The provisions of § 4-7, Minimum distance from other licensed premises, and § 4-8, Minimum distance from churches, schools, etc., of the Township Code shall not apply to licensees in the Glenpointe area known as the land in RC-1, RC-2 and RC-3 Zones on the Zoning Map of the Township of Teaneck. The number of liquor licenses for the Glenpointe area shall not exceed four, including hotel licenses.

The distance requirements from churches, public or private schoolhouses, public playgrounds or public recreation areas or buildings, as contained in § 4-8, shall be measured from the nearest part of the property line of one premises to the nearest part of the property line of the other premises, without regard to the manner in which a person would walk from the entrance of one premises to the entrance to the other premises.

(a) 
The distance requirement of this article from churches and public or private schoolhouses contained in § 4-8 may be waived at the issuance of the license and at each renewal thereafter by the Township Council, on authority and consent of such house of worship, school, or Board of Education, respectively, such waiver to be effective until the date of the next renewal of the license, subject to and all in accordance with N.J.S.A. 33:1-76 and 33:1-76.1.
(b) 
The distance requirements from a public playground and recreation areas and buildings may be waived by the Township Council.

Except as provided in Subsection (a) of § 4-10, the distance requirements of this article shall not apply to the renewal or person-to-person transfer of any license.
