The erection of arcades over a portion of the public sidewalks, subject to the following provisions, is hereby authorized within the area of the Diamond and those streets leading into the Diamond within a one-block area of the Diamond.
No arcade may be erected until the design thereof and the type of material to be used in its construction shall be approved by the Planning Commission of this Borough.
Any arcade erected pursuant to the provisions of this chapter shall extend over the sidewalk for a distance of 9 1/2 feet from the edge of the building to which it is attached; its height shall be not less than 10 feet and not more than 12 feet from the sidewalk at the outer edge of the arcade; and its height shall be not less than 12 feet nor more than 14 feet where the arcade is attached to the building.
One sign designating each business located in the arcade area may be erected on the arcade adjacent to such business, provided that such sign is 5 1/2 feet long, 1 1/2 feet in height and three inches in thickness and of wood, and further provided that it is erected along the outer edge of the arcade on the arch between supporting exterior posts, is centered in the arch and is attached to the underside of the arch, and further provided that the lower edge of said sign is at least 7 1/2 feet from the sidewalk.
Maintenance of the arcade and any signs erected under the provisions of this chapter shall be the sole responsibility of the owners of the building to which the arcade is attached.

Any property owners desiring to erect an arcade as aforesaid shall furnish to the Borough proof of public liability insurance covering such arcade in the amount of $1,000,000 per occurrence and $2,000,000 in the aggregate, which insurance shall remain in effect, and proof thereof shall be furnished yearly to the Borough so long as such arcade shall remain in existence; and such property owners shall also execute an agreement to save and hold harmless the Borough from injury to any person or property arising from the existence of such arcade.

Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof before the Magisterial District Judge, be subject to a fine not exceeding $600, plus costs of prosecution, and, in default of payment, imprisonment for a term not exceeding 30 days.
