This article shall be cited and may be referred to as the "Open
Alcoholic Beverage Container Law."
It is the intention of the Town Board of the Town of Waterford,
by the adoption of this article, to prohibit possession of open alcoholic
beverage containers in public places in the Town outside of the Village
of Waterford.

No person shall have in his possession, with the intent to consume,
any open bottle or container containing liquor, beer, wine or other
alcoholic beverage while such person is on any public highway, public
street, public park, public sidewalk, public parking area or in any
vehicle or public place, except those premises duly licensed for the
sale and consumption of alcoholic beverages on the premises.
An open bottle or open container in any vehicle shall be presumptive
evidence that the same is in possession of all occupants thereof and
a violation hereof.

A violation of this article shall constitute an offense punishable
by a fine not exceeding $250 or by imprisonment in the Saratoga County
Jail for not more than 15 days or by both such fine and imprisonment.
