The Town Board of the Town of Waterford is committed to the effective management of solid waste. Effective management is an evolutionary concept and the actual ongoing experience with that concept changes our official and personal awareness of its complexities.
B.ย 
The Town's enforcement and encouragement of recycling and reuse has been accompanied by an unanticipated increase in littering and unlawful refuse disposal on public highways and adjoining public and private lands. This unfortunate situation impairs the health and safety of our citizens, diminishes the beauty and viability of our scenic lands and increases our fiscal burdens.

A Town-wide prohibition against littering and unlawful refuse disposal will complement our commitment to effective management of solid waste and will supplement the state-wide prohibition of such actions codified in Vehicle and Traffic Law ยงย 1220 and the county-wide Unlawful Refuse Disposal Law. Effective management of solid waste mandates stricter penalties for littering and unlawful refuse disposal in the Town of Waterford.
All terms in this chapter shall be given the plain usage meaning.
No person shall throw, dump, deposit or place or cause to be thrown, dumped, deposited or placed upon any Town road or highway or park or within the limits of the right-of-way of such Town road or highway or park or upon private or public lands adjacent thereto any refuse, trash, garbage, rubbish, litter or any nauseous or offensive matter.
A violation of this chapter shall be punishable by a fine of a minimum of $250 and a maximum of $1,000 and/or up to 15 days in jail for each separate offense.
