GENERAL REFERENCES
Streets and sidewalks — See Ch. 97.
As used in this chapter, the following terms shall have the meanings indicated:
BOARD
The Village Board of Trustees of the Incorporated Village of Greenwood Lake.
GREENWOOD LAKE
That body of water, commonly known as "Greenwood Lake," the arms, estuary and extensions thereof, located within the incorporated boundaries of the Village of Greenwood Lake, State of New York.
OPERATE
To ride in or on, other than as a passenger; to use or control the operation of a snowmobile in any manner whether or not said snowmobile is underway.
OPERATOR
Every person who operates or is in actual physical control of a snowmobile.
OWNER
A person, other than a lienholder, having the property in or title to a snowmobile.
PERSON
An individual, partnership, corporation or any body of persons, whether incorporated or not.
SNOWMOBILE
A self-propelled vehicle designed for travel on snow or ice, steered by skis or runners and supported in part by skis, cleats or belts.
VILLAGE
The incorporated area in the Village of Greenwood Lake, County of Orange, State of New York.
A. 
For the purpose of allowing access of snowmobiles in recreation areas outside of the Village of Greenwood Lake, it is hereby deemed proper and advisable for the Board from time to time to approve, by resolution duly made, seconded and passed by majority vote, those streets and routes deemed uncongested enough for the purpose of operation of snowmobiles on the shoulders thereof. A copy of said resolution, containing the description of said routes and streets, shall be filed and posted in the Village Clerk's office and shall be available for public inspection during usual business hours. New routes shall become effective 15 days after filing in the Village Clerk's office, as aforesaid.
B. 
A failure to post shall not be deemed a defect or defense to the due enforcement of this section.
C. 
The rate of speed shall not exceed 15 miles per hour when operating a snowmobile on the designated routes approved pursuant hereto.
The speed limit on both arms of Greenwood Lake shall be a maximum speed of 15 miles per hour. On all other portions of Greenwood Lake lying within the incorporated boundaries of the Village of Greenwood Lake, any snowmobile may be operated at a rate of speed not greater than is proper or reasonable under the circumstances or in a manner so as to create an annual risk to person or property of another or to cause injury or damage thereto, except that for that portion of Greenwood Lake lying within the incorporated boundaries of the Village of Greenwood Lake but extending beyond the arms of said lake, the maximum speed of 15 miles per hour shall be in effect within 250 feet of all shorelines.
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
