The office of Parking Enforcement Officer as defined in N.J.S.A.
40:11A-22.1 is hereby created within the Borough of Westwood.
The Mayor and Council creates three such offices within the
Borough of Westwood, reserving, however, the right to fill such number
of the offices thus created as from time to time appears prudent and
necessary.
No person shall be appointed as a Parking Enforcement Officer
unless said person:
A.
Is and remains a resident of the State of New Jersey during the term
of appointment.
B.
Is able to read, write and speak the English language well and intelligently.
C.
Is of sound mind and in good health.
D.
Is of good moral character.
E.
Has not been convicted of any offense involving dishonesty or which
would make said person unfit to perform the duties of office.
Every applicant must be fingerprinted pursuant to N.J.S.A. 40:11A-22.3.
A.
The Parking Authority shall recommend suitable applicants to the
Mayor and Council.
B.
Said applicants shall complete such preemployment application, documentation
and examinations as are required by the Borough Administrator.
C.
The Chief of Police shall ascertain the eligibility and qualifications
of the applicant and report, in writing, these determinations to the
Mayor and Council.
D.
The Mayor and Council, in its discretion, shall thereafter appoint
such persons as appear to be suitable and qualified. Nothing in this
article shall require the Mayor and Council to appoint any particular
applicant or to take any action based upon a Parking Authority recommendation.
E.
All hiring shall be done in accordance with applicable statutes and
procedures.
F.
The Parking Authority shall establish an outline for a training course
to be conducted by it for all persons employed pursuant to this article.
The outline of said training course shall be filed with and approved
by the Chief of Police and the Administrator of the Borough of Westwood.
At a minimum, said training course shall:
(1)
Acquaint the Parking Enforcement Officer with the traffic and parking
regulations of the Borough of Westwood.
(2)
Acquaint the Parking Enforcement Officer with the applicable statutes
pertaining to motor vehicles and parking.
(3)
Acquaint the Parking Enforcement Officer with the general interrelationship
of the Parking Authority, the Police Department and the Mayor and
Council as a functioning governmental unit.
(4)
Acquaint the Parking Enforcement Officer with such safety and due
process requirements and considerations as are necessary to avoid
bodily injury, personal injuries or other claims and losses.
(5)
Acquaint the Parking Enforcement Officer with the proper means of
completing summons/complaints in such a manner as to ensure their
enforceability.
Pursuant to N.J.S.A. 40:11A-22.7, the Mayor and Council may
waive the training requirements hereinabove set forth, provided that
the Chief of Police shall certify, in writing, that the said individual
has the substantial equivalent training and background so as to make
the training hereinabove prescribed unnecessary.
Every Parking Enforcement Officer, prior to the commencement
of their duties, shall be furnished with a uniform which shall have
been designed by the Parking Authority of the Borough of Westwood,
subject to the approval of the Mayor and Council of the Borough of
Westwood. At a minimum, said uniform shall identify the person's function
and shall include a hat, an appropriate badge and an insignia.
All persons currently employed under the supervision and direction
of the Parking Authority, if any, as special law enforcement officers
and/or exercising the powers and authorities herein described for
Parking Enforcement Officers are hereby designated as same in the
same manner and to the extent as if they had been appointed hereunder.
