No person as defined herein shall consume alcoholic beverages
as defined herein in any place of public use as defined herein within
the geographical boundaries of the Borough of Westwood.
As used in this article, the following terms shall have the
meanings indicated:
Drinking or possession in open containers or possession in
nonoriginal containers of any alcoholic beverages, as defined by the
provisions of N.J.S.A. 33:1-1 et seq., within the geographical boundaries
of the Borough of Westwood.
Any natural person, corporation, firm, club, organization
or partnership. The singular shall include the plural, and the plural
shall include the singular. The masculine shall include the feminine.
Any facility available for public use or convenience, including
streets, highways, alleys, roads, sidewalks, parks or other public
grounds, parking lots, train and bus depots, lavatories, rest rooms,
vacant or unimproved vacant lands and other public or quasi-public
places, except therefrom any premises or places specifically licensed
for the sale or consumption of alcoholic beverages. These terms shall
include and extend to those places of public accommodation, such as
shopping centers and church yards within the geographical boundaries
of the Borough of Westwood, and said definition is not limited thereto.

Notwithstanding other provisions in this article, the Governing Body
of the Borough of Westwood may, by resolution of the majority of the
members of the Council present and voting, provided that a quorum
is present, permit the possession of or consumption of alcoholic beverages
in a place of public use, as herein defined, within the geographical
boundaries of the Borough of Westwood at a designated time or times
in connection with a specific event, series of events or observances
which have been authorized by the Governing Body.

Any person or persons granted permission hereunder by the Governing
Body of the Borough of Westwood shall comply with all statutory provisions
and regulations of the Alcoholic Beverage Control Commission and obtain
any and all necessary licenses and/or permits pursuant thereto.
It shall be a violation to consume alcoholic beverages as defined
herein on any private property without the express permission of the
owner or person or persons in interest thereof, or in charge thereof,
within the geographical boundaries of the Borough of Westwood.
Any person who shall violate the provisions of this article
shall be deemed to have committed a disorderly persons offense and
shall, upon conviction thereof, be punished by a fine of not more
than $500 and/or be imprisoned in the Bergen County Jail for not more
than 90 days.
