There is hereby created a Historic Preservation Advisory Committee.
A. 
The Historic Preservation Advisory Committee shall consist of seven regular members and two alternate members, designated as "Alternate No. 1" and "Alternate No. 2."
B. 
The terms of the regular members shall be four years and shall expire on December 31 of the last year of the term; provided, however, that the terms of the regular members initially appointed shall be so determined that to the greatest practicable extent the expiration of the terms shall be distributed evenly over the first four years after their appointment and provided that the initial term of no regular member shall exceed four years.
C. 
The terms of the alternate members shall be two years and shall expire on December 31 of the last year of the term; provided, however, that the terms of the alternate member's initially appointed shall be so determined that to the greatest practicable extent the expiration of the terms shall be distributed evenly over the first two years after their appointment and provided that the initial term of no alternate member shall exceed two years.
D. 
Appointments to the Historic Preservation Advisory Committee shall be made by the City Council.
E. 
A vacancy occurring otherwise than by expiration of the term shall be filled for the unexpired term only.
F. 
In making appointments, the City Council may, but shall not be required to, appoint at least one regular member from each of the following classes:
(1) 
Class A: a person who is knowledgeable in building design and construction or architectural history and who may reside outside the City of Englewood;
(2) 
Class B: a person who is knowledgeable or with a demonstrated interest in local history and who may reside outside the City of Englewood; and
(3) 
Class C: citizens of the City of Englewood who shall hold no other municipal office, position or employment except for membership on the Planning Board or Board of Adjustment.
G. 
The Council may but shall not be required to appoint at least one less than the majority of the regular members from Classes A and B.
H. 
Alternate members shall meet the qualifications of the Class C members.
I. 
A member of the Historic Preservation Advisory Committee may, after public hearing if he requests it, be removed by the City Council with or without cause.
A. 
The Committee shall meet regularly at the call of its Chairperson or, in absence of the Chairperson, the Vice Chairperson.
B. 
The Committee may establish such rules of procedure to govern its meetings as it may deem appropriate, not inconsistent herewith or other applicable law.
C. 
The secretary shall keep minutes and records of all meetings and proceedings, including voting records, attendance, resolutions, findings, determinations and decisions. All such material shall be public records.
D. 
Notice of all meetings shall be provided to the applicant at which an application for development or permit application shall be considered.
E. 
Alternate members may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member.
F. 
No member of the Historical Preservation Advisory Committee shall be permitted to act on any matter in which he or she has, either directly or indirectly, any personal or financial interest as those terms are defined in the Local Government Ethics Law (N.J.S.A. 40A:9-22.1).
G. 
The Historic Preservation Advisory Committee shall elect a Chairperson and Vice Chairperson from its members and select a secretary, who may or may not be a member of the Committee or a City employee.
A. 
Subject to the consent of the City Manager, the Historical Preservation Advisory Committee may employ, contract for and fix the compensation of experts and other staff and services as it shall deem necessary, provided that any expenditure therefor shall not exceed the amount appropriated by the City Council for the Committee's use.
B. 
The Committee shall obtain its legal counsel from the City Solicitor at the rate of compensation determined by the City Council.
C. 
The City Council may make such provision in its budget and appropriate such funds as it deems necessary for the expenses of the Historical Preservation Advisory Committee.
D. 
Committee members shall serve without compensation but may be reimbursed for expenses incurred in the performance of their official business, subject to the approval of the City Manager prior to incurring any such expense.
The Historic Preservation Advisory Committee shall have the responsibility to:
A. 
Prepare a survey of historic sites in the City, pursuant to criteria identified in the survey report.
B. 
Make recommendations to the Planning Board on the historic preservation plan element of the Master Plan and on the implications for preservation of historic sites of any other Master Plan elements.
C. 
Advise the Planning Board on the inclusion of historic sites in the recommended capital improvement program.
D. 
Advise the Planning Board and Board of Adjustment on applications for development, pursuant to § 8-35 of this article.
E. 
Provide written reports, pursuant to § 8-36 of this article, on aspects of applications for permits which affect historic preservation.
F. 
Carry out such other advisory, educational and informational functions as will promote historic preservation in the City.
The Planning Board and Board of Adjustment shall refer to the Historic Preservation Advisory Committee every application for development submitted to either Board for development. This referral shall be made when the application for development is deemed complete or is scheduled for a hearing, whichever occurs sooner. Failure to refer the application as required shall not invalidate any hearing or proceeding. The Historic Preservation Advisory Committee may provide its advice, which shall be conveyed through its delegation of one of its members or staff to testify orally at the hearing on the application and to explain any written report which may have been submitted.
All applications for issuance of permits for the alteration, renovation, demolition and construction of buildings and structures in historic zoning districts or on historic sites designated on the Zoning or Official Map or identified in any component element of the Master Plan which affect the exterior of such premises shall be referred to the Historic Preservation Advisory Committee, which shall provide a written report on any aspects of the proposed change which concern historic preservation and provide advice to the administrative officer or officers and to the property owner unless those aspects were determined by approval of an application for development by a municipal agency pursuant to the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.). The Historic Preservation Advisory Committee shall report to the administrative officer or officers within 20 days of his referral of an application to the Historic Preservation Advisory Committee.
The intent of this article is to establish an advisory committee with limited responsibilities rather than a Historical Preservation Commission pursuant to N.J.S.A. 40:55D-107 et seq.
