A. 
The Englewood Fire Department Division of Emergency Medical Services (EFDDEMS) is hereby established.
B. 
The creation of EFDDEMS by this article is in no way intended to amend, effect, or apply to the already existing Englewood Volunteer Ambulance Corps.
As used in this article, the following terms shall have the meanings indicated:
CREW CHIEF
An employee assigned to a position requiring the exercise of immediate supervision over the actions of other employees.
DEPENDENT
A. 
Any individual who is the spouse or an unemancipated child (natural, adopted, or step-child) of a taxpayer as described in the definition of "domiciled resident."
B. 
Any unemancipated child for whom the taxpayer or resident has been appointed legal guardian.
C. 
Any individual who resides in a permanent domicile of the taxpayer or domiciled resident and is claimed as a dependent for federal income tax purposes.
D. 
Any individual who resides in the permanent domicile of the taxpayer or domiciled resident and who is deemed to be a dependent under the health insurance policy of the taxpayer or domiciled resident.
DOMICILED RESIDENT
Any individual whose legal domicile is within the City of Englewood. Verification of domicile shall be based on voter registration, a State of New Jersey income tax return from a City of Englewood address or other proofs accepted under federal guidelines.
EMERGENCY MEDICAL SERVICES
Any services, including transportation, provided by the EFDDEMS to a potentially or actually ill or injured person in response to a call for service.
EMS SUPERVISOR
An officer of the Englewood Fire Department that is directly responsible for the day-to-day management, supervision and efficiency of all operational and administrative activities of the EFDDEMS. The EMS Supervisor shall be appointed by and be subject to the overall authority of the Fire Chief.
FIRE CHIEF
The person that is directly responsible for the overall operation, budget, and efficiency of the EFDDEMS, subject to the authority of the City Manager.
HEAVY RESCUE
Any technical rescue procedures, including but not limited to water and ice rescue, rope rescue, confined-space rescue, high-angle rescue, trench rescue, or structural collapse rescue; additionally, any motor vehicle rescue that includes the use of power tools and hydraulic tools to perform operations such as partial or full roof removal, front dash displacement, third door access, and/or separating vehicles from one another.
LIGHT RESCUE
Maintaining battery issues/disconnects, fluid cleanup, stabilization of vehicles, use of hand tools, hazard control, and any other emergency-scene-related light rescue operations.
MEDIUM RESCUE
Use of power tools and hydraulic rescue tools to perform activities such as opening or removing doors to provide access to patients as well as stabilizing vehicles, hazard assessment, and/or hazard control.
NEW JERSEY DEPARTMENT OF HEALTH AND SENIOR SERVICES
The state department that certifies, authorizes, and regulates all emergency medical service operational and training requirements.
PER DIEM EMPLOYEE
A person who performs in the capacity of an emergency medical technician for the EFDDEMS.
TAXPAYER
Any individual listed on the deed of ownership of any property located within the municipal boundaries of the City of Englewood and their dependents. In the case of a corporation or partnership, only those individuals retaining a twenty-five-percent or greater ownership or adult married or civil union partners may combine their ownership. A dependent shall be considered a taxpayer.
THIRD PARTY BILLING AGENCY
A business entity engaged by the City of Englewood for the purpose of affecting the billing of patients and collecting payments therefrom, which payments shall be remitted to the City of Englewood.
The EFDDEMS shall consist of such number of per diem employees required to assure the efficient and effective delivery of emergency medical services to the community. The number of employees shall be determined by the Fire Chief and approved by the City Manager. These members shall be compensated at an hourly rate for his/her service in the EFDDEMS. Per diem employees may not be regularly employed in excess of 30 hours per week. Per diem employees shall not be eligible for benefits provided under Chapter 56, Personnel, of the Code of the City of Englewood.
Members employed by EFDDEMS will be required to meet all hiring criteria and procedures utilized by the City of Englewood Department of Human Resources, including the City of Englewood's drug and alcohol testing policies. In addition, only those prospective employees that meet all preestablished certification and job description standards set forth by the City of Englewood will be permitted to apply for employment.
A. 
Per diem employees may work a maximum of 30 hours per week. This may be exceeded only when a life-threatening incident is in progress, a recall of personnel occurs, or during a declared state of local emergency.
B. 
Per diem employees shall be compensated at an hourly rate as set by the Fire Chief upon approval of the City Manager.
C. 
Per diem employees shall not be eligible to become certified as regular full- or part-time employees of the City unless the per diem employee is hired by the City to perform a job that requires regular full- or part-time employment.
D. 
Per diem employees shall not be eligible to receive any health insurance, including medical, dental, or vision, vacation, or any other leave or compensatory time, or any benefit of employment not specifically set forth in the chapter.
E. 
Per diem employees shall be covered by workers' compensation insurance and all City insurance liability and defense policies as the City may, from time to time, declare, carry, amend, or discontinue, in the City's sole discretion. In the event of a line of duty death, the City shall ensure that all applications are processed and procedures followed for any eligible state or federal benefits.
F. 
Per diem employees shall be eligible to enroll in the Public Employees Retirement System (PERS)
In their sole discretion, should the City Council consider at any time that the interests of the City will be best served by the disbandment of the EFDDEMS for any cause, or in the interest of economy and efficiency, they may do so at any regular meeting by a majority vote of the City Council.
The Fire Chief (or his designee) shall be directly responsible for the overall operation, budget, efficiency, and management of the EFDDEMS subject to the authority of the City Manager. The Fire Chief shall:
A. 
Administer and enforce the rules and regulations of the City of Englewood Fire Department, New Jersey Department of Health and Senior Services, EFDDEMS, Department of Human Resources, and all other City of Englewood personnel policies for the disposition and discipline of the EFDDEMS and its employees.
B. 
Develop policies and procedures necessary to govern and direct the day-to-day operations of the EFDDEMS.
C. 
Maintain the overall discipline of the EFDDEMS.
D. 
Delegate such authority as may be deemed necessary for the efficient operation of the EFDDEMS to be exercised by the EMS Supervisor under the direction and control of the Fire Chief (or his designee).
E. 
Prepare and submit the annual budget and proposed expenditure program to the City Manager.
F. 
Allocate funds within the budget which are approved and appropriated by the City Manager and the City Council.
The Fire Chief shall assign an officer of the Fire Department to serve as the EMS Supervisor. He/She shall be directly responsible for the day-to-day management, supervision, and efficiency of all operational and administrative activities of the EFDDEMS subject to the authority of the Fire Chief. The Fire Lieutenant/EMS Supervisor shall have the following certifications prior to assignment: EMT-B, BLS for Healthcare Provider or equivalent, 1300, 1700, Hazardous Material Operations, CBRN Operations. He shall report directly to and be subject to the overall authority of the Fire Chief. The duties and responsibilities of the EMS Supervisor shall be established by the Fire Chief and set forth in an order.
The Fire Chief and EMS Supervisor are hereby authorized, empowered, and required when necessary to follow all Englewood Fire Department and EFDDEMS Rules and Regulations, New Jersey Department of Health and Senior Services, Department of Human Resource policies, and City of Englewood personnel guidelines to control, manage, and govern the EFDDEMS. EFDESM employees shall be subject to these rules and regulations.
