A. 
Complaints and grievances of employees in the classified service and employees in the unclassified service whose employment is covered by collective negotiation agreements which include a grievance procedure shall be handled and resolved in the manner specified in such agreements.
B. 
Whenever any other employee in the unclassified service has a complaint or grievance relating to his or her employment, such grievance shall be processed and resolved in the manner hereinafter prescribed in this article.
If the employee's immediate superior is someone other than a department head, such grievance shall be presented informally, either verbally or in writing, to such immediate superior, who shall have a period of two working days within which to satisfactorily resolve the grievance.
If the employee is not satisfied with the action of his or her immediate superior with respect to the grievance, or if the employee's immediate superior is a department head, then such grievance shall be presented to such department head, which presentation may be verbal or in writing unless the department head requires the same to be presented in writing. The department head shall have a period of two working days within which to attempt to resolve the grievance and shall advise the employee, in writing, of this decision with respect thereto within such period, or, if resolution of the grievance requires an exercise of discretion or authority which is not vested in the department head, the department head shall so advise the employee within such time period.

If the grievance is not resolved by the department head in a manner satisfactory to the employee or if the department head advises the employee that resolution of the grievance is not within the scope of this authority, the employee may next present such grievance to the City Manager by submitting same in writing, with full details and particulars of the nature of the grievance and including a copy of the decision rendered thereon by the department head, a copy of which presentation shall be furnished to the department head.
B. 
Within two working days following receipt of a copy of such presentation to the City Manager, the department head shall submit to the City Manager a written response thereto and shall furnish a copy of such response to the employee who submitted the grievance.
C. 
The City Manager shall hold a hearing on the grievance at which the employee and the department head may be heard and shall resolve the grievance and advise both the employee and the department head of his decision within 10 working days from his receipt of the grievance.[1]

All papers and documents relating to a grievance and its disposition shall be placed in the employee's personnel file in the Human Resources Department.
