No person under the age of 18 years shall remain in or upon
any of the streets, sidewalks, alleys or public places in the Village
of North Collins, New York, between the hours of 10:00 p.m. and 5:00
a.m. Eastern standard time or Eastern daylight saving time, as the
case may be, unless accompanied by a parent, guardian or other person
having legal custody or control of such minor person or whose employment
or school activities make it necessary to be upon such streets, sidewalks,
alleys or public places or unless actually proceeding to a lawful
definite destination, without delay, during the nighttime between
such specified hours; provided, however, that such exceptions shall
not apply when the person under such age shall be playing or unnecessarily
loitering in or upon any such street, sidewalk, alley or public place.
No parent, guardian or other person having the legal care, custody
or control of any child under the age of 18 years shall knowingly
allow or permit any such person to go or be in or upon any of the
streets, sidewalks, alleys or public places in the Village of North
Collins, New York, within the time specified in this chapter, unless
there exists reasonable necessity therefor.
A.Â
All persons between the ages of seven years and 16 years violating
any of the provisions of this chapter shall be deemed and are hereby
declared to be neglected or delinquent and within the provisions of
Article 3 of the Family Court Act.
B.Â
Any child under the age of seven years violating any of the provisions
of this chapter shall be conducted by any police officer discovering
such violation to the child's home, and such policeman shall
forthwith report, in writing, the name and residence of the parents
of such child to the chief law enforcement agent of the Village of
North Collins, New York. Should it appear that such child falls within
the provisions of Article 3 of the Family Court Act, such child shall
be dealt with as provided in such law.

Any person over the age of 16 years convicted of violating any provision
of this chapter shall be deemed to be guilty of an offense and shall
be subject to a fine of not more than $250 or imprisonment for not
more than 15 days, or both.
D.Â
Any person under the age of 16 years convicted of violating any provisions
of this chapter shall come within the provisions of Article 3 of the
Family Court Act.
