No person or persons, partnership or corporation shall make
or cause to be made or permitted any unnecessary and unreasonably
loud, disturbing noise or any raucous, annoying sounds so as to disturb
the comfort, peace, repose, quiet and tranquility or which injures
or endangers the health or welfare of others within the limits of
the village.
A.
The following acts are declared to be loud, disturbing, raucous,
annoying and unnecessary noises in violation of this section, but
said enumeration shall not be deemed to be exclusive, namely:
(1)
The playing of any radio, phonograph, television or any musical instrument
or singing and talking in such a manner or in such volume as to annoy
or disturb the quiet, comfort or repose of persons within the village
in any type of dwelling, particularly during the hours between 11:00
p.m. and 8:00 a.m. on any weekday and at any time on Sunday.[1]
(2)
The sounding of any horn or signal device by any automobile or other
vehicle for any unnecessary period of time while the vehicle is not
in motion except as a danger signal.
(3)
The conduct of any business or commercial enterprise which by reason
thereof causes continued loud disturbing noises.
(4)
The operation or propelling of any vehicle, motorcycle, motorboat
or launch within the jurisdiction of the village without an efficient
and proper muffler.
B.
Exception. Nothing herein contained shall be construed to apply to
church bells or chimes.
Any person committing an offense against any provision of this
chapter shall be guilty of a violation punishable by a fine not exceeding
$250 or by imprisonment for a term not exceeding 15 days, or by both
such fine and imprisonment. The continuation of an offense against
the provisions of this chapter shall constitute, for each day the
offense is continued, a separate and distinct offense hereunder.
