This chapter shall be enforced by the Building Inspector designated
by the Village Board. No building permit or certificate of occupancy
shall be issued by him except where the provisions of this chapter
have been complied with. Said Building Inspector may institute any
appropriate action or proceeding to prevent the violation of this
chapter.
No building or structure shall be erected, added to or structurally
altered until a permit therefor has been issued by the Building Inspector.
All applications for such permits shall be in accordance with the
requirements of the New York State Uniform Fire Prevention and Building
Code and with all pertinent health laws and regulations, including
the Erie County Sanitary Code and this chapter.
No use or occupancy of land shall be hereafter established and
no building hereafter erected, altered or extended shall be used or
changed in use until a certificate of occupancy shall have been issued
by the Building Inspector in accordance with the provisions of the
New York State Uniform Fire Prevention and Building Code and this
chapter. Where the approval of the Erie County Department of Health
is required, the certificate of occupancy specified in this section
shall not be issued until such approval has been granted in writing.
A.
Fees for a building permit or certificate of occupancy shall be as set by Chapter 62, Building Construction, of the Code of the Village of North Collins, and fees for such permits paid under the provisions of that chapter shall be deemed to meet the requirements of this chapter. Where a certificate of occupancy is required under this chapter and not under the provisions of said Chapter 62, the fee shall be $50.
B.
Whenever a petition for an amendment to this chapter, either text
or map, or both, is submitted to the Village Board, it shall be accompanied
by a fee of $50. Said fee shall be collected by the Village Clerk.
C.
Whenever a petition for relief is submitted to the Zoning Board of
Appeals, it shall be accompanied by a fee of $50. Said fee shall be
collected by the Village Clerk.
In their interpretation and application, the provisions of this
chapter shall be held to be minimum requirements adopted for the promotion
of the public health, morals, safety or general welfare. Wherever
any requirement of this chapter is at variance with a requirement
of any other lawfully adopted rules, regulations or ordinance, the
more restrictive or that imposing the higher standards shall govern.
