No person shall ascend or land with any aircraft, including gliders and parachutes, or engage in stunt flying or parachute landing within the corporate limits of the Village without written permission from the Chief of Police. It shall be a defense to a prosecution under this chapter that the landing of any such aircraft was due to an emergency which necessitated an emergency landing.
The takeoff and landing provisions of this chapter do not apply to:
An actual emergency landing or emergency takeoff where no other reasonable alternative exists, provided that the owner or operator of the aircraft submits to the Chief of Police a sworn statement explaining the circumstances of the emergency within 72 hours of the landing or takeoff which would, but for the emergency, be in violation of this chapter; or
Aircraft used to transport injured persons, evacuees, medical personnel, or public officials in the event of an accident, disaster, or emergency where the aircraft operator believes that the circumstances require departure from the takeoff and landing rules of this chapter in order to preserve life or limb or the public safety.
For purposes of this chapter, "emergency landing" or "emergency takeoff" means a landing or takeoff, as applicable, necessary to preserve life or limb in imminent danger of being lost.
