Editor's Note: This ordinance repealed former Art. II, Disposal
of Septic Tank Effluent and Wastes, adopted 11-27-1973 by Ord. No.
1378 as Ch. 118, Art. I, of the 1973 Code.
No person, firm or corporation shall:
B.
Dispose of or dump any septic tank effluent or waste at any municipal
sanitary landfill site without having first paid said Township the
proper fees and charges for such disposal, which fees are hereinafter
fixed and determined.
C.
Dispose of or dump any septic tank effluent or waste at any municipal
sanitary landfill site except in the immediate presence and under
the direction of the Township Director of Public Works or his representative,
who shall be the employee of and representative of the Township then
in charge of the said site.
D.
Fail or refuse to advise and tell the Township Director of Public
Works, or his representative then in charge of his office, the precise
source or sources of the effluent and waste, in order that Toms River
Township Council may know how much of said effluent and waste comes
from Toms River Township, and the sources of the residue.
E.
Present to any municipal site or Township employee any commercial
or industrial waste to be disposed of at municipal sanitary landfill
site. The intent of the municipality is to accept only the usual type
of septic tank effluent and waste.
The proper fees and charges for disposal of septic tank effluent
and waste at any municipality-designated sanitary landfill site in
this municipality shall be and are hereby fixed and determined as
follows:
All said fees and charges are to be paid in cash or its equivalent,
in advance, to Toms River Township at the office of Township Director
of Public Works, before the respective vehicles containing effluent
or waste enter the municipal sanitary landfill site.
Said Township Director of Public Works shall:
A.
Be responsible for all fees and charges collected or which should
be collected pursuant to this article;
B.
Keep a detailed daily account of all such fees and charges;
C.
Promptly deposit such fees and charges in an account to the credit
of Township of Toms River in a Member FDIC, Qualified Banking Institution.
D.
Make a monthly written report thereon to the Township Clerk; and
E.
Remit monthly all such fees and charges collected to that time.
All fees and charges referred to herein are raised for revenue
and police regulation and powers purposes, and belong to and are the
property of the Township of Toms River.
The Township Director of Public Works, aforesaid, shall keep
at least one municipal sanitary landfill site open daily from 8:00
a.m. to 10:00 p.m. after the effective date of this article, for the
disposal of septic tank effluent and waste as contemplated and described
herein.
Any person convicted of a violation of any of the provisions
of this article shall suffer a penalty of not exceeding $200 or not
exceeding 30 days' imprisonment in the Ocean County Jail, or
both, at the discretion of the Magistrate before whom such conviction
is had. Any firm or corporation convicted of a violation of any of
the provisions of this article shall suffer the penalty of a fine
of not exceeding $200.
In addition to the penalties set forth in the preceding section,
the Township of Toms River, in the County of Ocean, reserves the right
to refuse to accept septic tank effluent and waste from any person,
firm or corporation who or which refuses or neglects to comply with
the provision of this article.
