The title of this chapter shall be the "Games of Chance Licensing
Law of the Village of Medina, New York."
A.
The State of New York has enacted General Municipal Law Article 9-A,
granting to every municipality the right, power and authority to authorize
the conduct of games of chance by authorized organizations within
the territorial limits of such municipality. If a local law or ordinance
authorized by General Municipal Law Article 9-A is adopted by a town,
such a law shall be operative in any village within the town only
if the Board of Trustees of said village adopts a local law or resolution,
subject to permissive referendum as provided in Village Law Article
9, authorizing the issuance of licenses by the town for games of chance
within such village.
B.
The Town of Shelby, within which the Village of Medina is partially
located, duly adopted Local Law No. 3 of the Year 1986, known as the
"Games of Chance Law of the Town of Shelby," pursuant to the aforementioned
authority contained in General Municipal Law Article 9-A, which local
law provides that it shall be lawful for any authorized organization,
upon obtaining a license therefor as required, to conduct games of
chance within the territorial limits of the Town of Shelby, subject
to the provisions of the local law, General Municipal Law Article
9-A, and the rules and regulations of the New York State Racing and
Wagering Board, now known as the New York State Gaming Commission.
C.
The Town of Ridgeway, within which the Village of Medina is partially
located, duly adopted Local Law No. 3 of the Year 1988, known as the
"Games of Chance Law of the Town of Ridgeway," pursuant to the aforementioned
authority contained in General Municipal Law Article 9-A, which local
law provides that it shall be lawful for any authorized organization,
upon obtaining a license therefor as required, to conduct games of
chance within the territorial limits of the Town of Ridgeway, subject
to the provisions of the local law, General Municipal Law Article
9-A, and the rules and regulations of the New York State Racing and
Wagering Board, now known as the New York State Gaming Commission.
D.
This chapter is enacted by the Village of Medina for the purpose
of authorizing the issuance of licenses by the Towns of Shelby and
Ridgeway for games of chance to be conducted within their respective
portions of the Village of Medina.
As used in this chapter, the following terms shall have the
meanings indicated:
An authorized organization as defined in General Municipal
Law § 186, Subdivision 4.
A game of chance as defined in General Municipal Law § 186,
Subdivision 3.
The Village of Medina, New York.
A.
The Towns of Shelby and Ridgeway are authorized to issue licenses
to authorized organizations to conduct games of chance within their
respective portions of the Village of Medina, subject to the provisions
of each town's local law, General Municipal Law Article 9-A,
and the rules and regulations of the New York State Gaming Commission.
B.
Authorized organizations may conduct games of chance within the Village
of Medina; Orleans County, New York, upon obtaining a license issued
by the Clerk or other designated officers of the Town in which the
games are proposed to be conducted. Authorized organizations desiring
to conduct games of chance within that portion of the Village of Medina
which lies in the Town of Ridgeway shall obtain a license from the
Clerk or other designated officer of the Town of Ridgeway, and authorized
organizations desiring to conduct games of chance within that portion
of the Village of Medina which lies in the Town of Shelby shall obtain
a license from the Clerk or other designated officers of the Town
of Shelby. All such games of chance shall be conducted in accordance
with Article 9-A of the General Municipal Law, the local laws of the
town wherein the games are conducted, and the rules and regulations
of the New York State Gaming Commission.
A.
This chapter is subject to permissive referendum as provided in Article
9 of the Village Law.
B.
This chapter shall take effect immediately upon filing with the Secretary
of State following the expiration of the thirty-day permissive referendum
period after its adoption if no valid petition be filed requesting
that the same be submitted to the electors of the Village for their
approval or disapproval, or following its approval at referendum by
a majority of qualified voters voting thereon if a valid petition
requesting such election is presented in timely fashion.
