For each tree removed having a caliper of more than nine inches measured at a height of four feet from the finished or existing grade level, the applicant shall prepare a replanting scheme on other treeless portions of the property to counterpoise the clearing and grading of the tree area where such clearing and grading was necessitated by the site plan or unless otherwise provided in accordance with the requirements of an approved site plan or preliminary subdivision.
The Township Engineer shall also require that if the site to be cleared does not permit the replanting of the trees, an off-site tract may be selected for such replanting, and an off-site plan shall be prepared by the applicant.

The Director of Public Works or the Director of the Shade Tree Commission shall enforce this article. Any person(s) who is found to be in violation of the provisions of this article shall be subject to a fine of $875. The removal of a tree of significance is not subject to a fine limit, which shall be fixed by the Municipal Court of the Township of Clark in its discretion, but such fine shall in no event be less than $875.
