[Adopted by Ord. No. 01-10 (Sec. 11-7 of the 2002 Revised General Ordinances)]
Any tree cut down or illegally removed in the Clark Wildlife Preserve and Habitat shall be replaced by the Township, at the cost of the offender, in accordance with the following sections.
A. 
Trees equal to or less than six inches in diameter. For each tree removed under this article with a caliper of six inches or less, measured from the base of the trunk at a distance of six feet, shall be replaced with two replacement trees as defined in § 338-25.
B. 
Trees more than six inches but less than or equal to 12 inches in diameter. For each tree removed under this article with a caliper of more than six inches but less than or equal to 12 inches, measured from the base of the trunk at a distance of six feet, shall be replaced with three replacement trees as defined in § 338-25.
C. 
Trees more than 12 inches but less than or equal to 18 inches in diameter. For each tree removed under this article with a caliper of more than 12 inches but less than or equal to 18 inches, measured at a distance of six feet from the base of the trunk, shall be replaced with four replacement trees as defined in § 338-25.
D. 
Trees larger than 18 inches. For each tree removed under this article with a caliper of more than 18 inches, measured at a distance of six feet from the base of the trunk, shall be replaced with five replacement trees as defined in § 338-25.
A replacement tree for this article must have a caliper of three inches measured at a height of six feet from the base of the tree trunk and must be a species native to the Clark Wildlife Preserve and Habitat as determined by the Environmental Commission.
Any person who shall fail to reimburse the Township as set forth in this article shall be liable to penalties as provided by Chapter 1, Article III.
This article shall be enforced jointly or severally by the Director of the Clark Shade Tree Commission or the Director of Public Works.
