The unregulated parking of vehicles on certain roads and highways
situate within the Town of Johnstown has impeded the orderly and normal
flow of traffic. The Town Board of the Town of Johnstown therefore
determines that it is in the best interest of the public health, safety
and welfare of the citizens of the Town of Johnstown to regulate the
parking of vehicles within the Town of Johnstown.

As used in this Article, the following terms shall have the meanings
indicated:
Every natural person, firm, copartnership, association or
corporation.
Any officer authorized to direct or regulate traffic or to
make arrests for violations of traffic regulations and shall also
mean the Constable of the Town of Johnstown.
Every way or place in private ownership and used for vehicular
traffic by the owner and those having express or implied permission
from the owner, but not by other persons.
Pedestrians, ridden or herded animals, vehicles and other
conveyances, either singly or together, while using any street for
purposes of travel or parking.

Whenever any words or phrases used herein are not defined herein
but are defined in the Vehicle and Traffic Law of the state, any such
definition therein shall be deemed to apply to such words and phrases
used herein.
No person shall park any vehicle in such a manner as to block
the entrance to any public parking lot or any private road or driveway.
When signs are erected giving notice thereof, no person shall:
The Town Board shall have the authority to designate, by resolution,
those roads or highways or portions thereof within the Town of Johnstown
which shall be subject to these regulations prohibiting parking or
standing on such roads or limiting parking or standing to 120 consecutive
minutes. Upon adoption of such a resolution, the Town Superintendent
of Highways shall thereafter cause to be erected upon such road or
highway an appropriate sign.

A violation of any provision of this Article shall be deemed
a traffic infraction and shall be punishable as follows:
A.Â
For a first conviction thereof, by a fine of not more than $50 or
by imprisonment for not more than 15 days, or by both such fine and
imprisonment.
B.Â
For conviction of a second violation, both of which were committed
within a period of 18 months, by a fine of not more than $100 or by
imprisonment for not more than 45 days, or by both such fine and imprisonment.
C.Â
Upon conviction of a third or subsequent violation, all of which
were committed within a period of 18 months, by a fine of not more
than $250 or by imprisonment for not more than 90 days, or by both
such fine and imprisonment.
