The Warden shall have the responsibility and the authority for
the transportation of any prisoner legally committed to the Worcester
County Jail from the time of the lawful commitment until discharged,
released or withdrawn from the jail pursuant to legal authority. This
shall include the transportation to and from court, medical facilities,
rehabilitation programs and other institutions but shall specifically
exclude transportation of prisoners for those purposes as stated in
§ PS 5-202 herein. The Sheriff shall assist the Warden in
fulfilling transportation responsibilities as necessary.
(a)
Responsibilities of law enforcement agencies. It shall be the responsibility of the arresting law enforcement
agency to deliver any lawfully committed prisoner to the Worcester
County Jail. It shall be the responsibility of the Sheriff of Worcester
County to transport any prisoner who is legally required to be present
at any court proceeding in another jurisdiction. Transportation of
any prisoner being held in the Worcester County Jail for any federal,
state, other county or municipality shall be the responsibility of
that agency.
(b)
Responsibility of work release prisoners. Prisoners
participating in an approved work release program shall be responsible
for their own transportation. Prisoners working on public property
pursuant to § PS 5-301 herein shall be transported to the
work site by the appropriate county or municipal agency or department.
The Warden may release prisoners into the custody of the Commissioner
of Corrections or any federal, state, county or municipal law enforcement
agency where such transfer of custody may be necessary for such prisoner
to attend court, be confined temporarily in another jurisdiction,
receive medical services or attend rehabilitation programs.
