On and after July 1, 2007, newly appointed officials in the Borough must enroll in DCRP, not PERS, if the position requires the specific consent and/or approval of the Mayor and Council. Borough employees appointed to a position by elected officials, such as Mayoral appointments, or appointments made with the "advice and consent" of the Council shall also be DCRP positions.
An appointed official in the Borough who is already enrolled in the PERS prior to July 1, 2007, based on an elected and/or appointed office, will remain a PERS member while in that office/position. If, however, on or after July 1, 2007, there is a break of service in that office/position, or the official is elected to a different elected office, the official will be enrolled in the DCRP and cannot continue with PERS membership in the newly elected office/position.
Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:

Borough Administrator;
B. 
Court Administrator;
C. 
Municipal Attorney;
D. 
Municipal Engineer;
E. 
Municipal Prosecutor;
F. 
Municipal Court Judge;
G. 
Recreation Director;
H. 
Any other department head appointed by the governing body unless otherwise exempt pursuant to N.J.S.A. 43:15C-2.
Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:
A. 
Certified Health Officer;
B. 
Tax Collector;
C. 
Chief Financial Officer;
D. 
Construction Code Official;
E. 
Qualified Purchasing Agent;
F. 
Tax Assessor;
G. 
Municipal Planner;
H. 
Registered Municipal Clerk;
I. 
Licensed Uniform Subcode Inspector;
J. 
Principal Public Works Manager.
This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.), as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
A copy of this article shall be filed with the Director of the Division of Pensions and Benefits of the New Jersey Department of the Treasury.

To receive lifetime health benefits paid for by the Borough, an employee must meet the following criteria (unless otherwise provided by collective bargaining agreements, personal service contracts, or by law):
A. 
The employee worked on a full-time basis (thirty-five-hour minimum) for the Borough of Haledon in a position that qualified such employee for health insurance.
B. 
The employee worked for the Borough in a position or positions that met the above criteria for a period of at least 25 years.
C. 
The employee retired from a full-time employment position with the Borough of, Haledon through either a service retirement or a disability retirement, as defined by the Public Employee's Retirement System (PERS), or under the terms of any collective bargaining agreement or personal services agreement. If an employee who otherwise meets the criteria for lifetime health benefits decides to take early retirement as defined by PERS, he or she shall be eligible to receive these benefits upon attaining age 64.
A. 
The employee will be enrolled in employee-only coverage unless a change is agreed to by the Borough.
B. 
The Borough shall have the right, in the future, to change health insurance plans as it deems necessary. If this occurs, the employee receiving such lifetime benefits shall be covered by the health insurance plan selected by the Borough and an employee will be enrolled in that program of the new health insurance plan most similar to the program (in the health insurance plan in effect prior to the change) in which said employee was enrolled.
If the employee is eligible for enrollment in Medicare, he/she must enroll in and purchase Medicare Part B at his/her sole cost. The Borough's insurance shall cease when the employee turns 65 years of age.
A. 
If a retiree who is receiving health benefits from the Borough of Haledon secures another employment position that provides any health insurance coverage, the employee must accept same coverage and immediately notify the Borough Clerk of the date such insurance becomes effective.
B. 
Upon receipt of such information, the Borough will notify the Borough's insurance carrier and the employee's coverage will be discontinued forthwith.
C. 
If, subsequently, the employee terminates his/her employment in such position, the employee shall immediately notify the Borough, and the employee will be reinstated to the Borough's insurance plan at the Borough's expense, subject to any reenrollment/eligibility waiting periods as may be applicable to the Borough's then-existing health insurance plan.
D. 
Any premiums paid by the Borough on behalf of an employee who had health insurance coverage offered to him/her by virtue of employment secured after retirement from the Borough, but failed to notify the Borough of such coverage, will be the responsibility of the employee and the Borough shall be entitled to pursue recovery of any payments made by the Borough during such time period, including any legal fees and costs incurred in pursuit thereof.
To the extent the terms and provisions of this article differ or conflict with any practice or custom of the Borough of Haledon with respect to lifetime health benefits for employees, the terms and provisions of this article shall supplant and supersede any such practice or custom.
All ordinances and resolutions inconsistent with the provisions of this article are hereby repealed as to such inconsistencies.
This article shall take effect immediately after final passage (adoption), approval and publication of notice thereof as required by law.
