[HISTORY: Adopted by the Town Board of the
Town of Fulton 9-12-1996 as Ch. 1, Part I of the 1996 Code. Amendments noted where

The Town Board of the Town of Fulton has the
specific authority, pursuant to §§ 5.15, 5.25, 5.40,
5.91, 6.27, 6.79, 8.05, 60.10, 60.21, 60.30, 60.305, 60.307 and 66.0501,
Wis. Stats., to regulate elections, establish election procedures
and to establish certain offices and the terms of those offices.
The Town Board of the Town of Fulton has, by
adoption of this chapter, confirmed the statutory authority, powers
and duties in Chs. 5, 6, 7, 8, 60 and 66, Wis. Stats., and establishes,
pursuant to the above-noted chapters and this chapter, other statutory
authority, powers and duties of the Town Board of the Town of Fulton
related to certain elections, certain election procedures and certain
offices and the terms of those offices.
A.
General authority.

The Chairperson and two Supervisors receiving the
highest number of votes in the spring election of 2001 shall serve
two-year terms. The other two Supervisors receiving the next highest
vote total in the spring election of 2001 shall serve one-year terms.

At the annual spring election of each year succeeding
the April 2001 annual spring election, the Supervisors elected shall
serve two-year terms, the intent being that elections shall occur
in both odd-numbered and even-numbered years.
B.
Combining offices. The Annual Town Meeting of 1992
authorized the combination of the offices of Town Clerk/Treasurer.
C.
Appointing Town Assessor. The Town Board of the Town
of Fulton, by authority granted to it at the Town of Fulton Town Meeting,
has, by this chapter, created an appointed Assessor system. The Town
Assessor of the Town of Fulton, by this chapter, is appointed by or
contracted with the Town Board of the Town of Fulton for a term of
one year.[1]
A.
The Town Board of the Town of Fulton shall, if the
Town Board contains three Town Board Supervisors, be elected in the
spring election in April in the odd-numbered years. If the number
of Town Board Supervisors in the Town of Fulton is or has been expanded
to four members by ordinance of the Town Board of the Town of Fulton,
then two Town Board Supervisors will be elected in the spring election
in April of the even-numbered years and two Town Board Supervisors
will be elected in the spring election in April in the odd-numbered
years. If the number of Town Board Supervisors of the Town of Fulton
is or has been expanded to five members by ordinance of the Town Board
of the Town of Fulton, then three Town Board Supervisors, including
the Town Chair, will be elected in the spring election in April of
the odd-numbered years and two Town Board Supervisors will be elected
in the spring election in April of the even-numbered years.
B.
If the Town of Fulton population is 2,500 or more,
the Town Meeting may direct that the Town Board of the Town of Fulton
shall consist of five Town Board Supervisors and that these five Town
Board Supervisors be elected at large. The terms of the Town Board
of the Town of Fulton shall then be staggered. During the first term
of expanded membership the two new members will be initially elected
for a one-year term.
A.
Any person who is a qualified elector in the Town
of Fulton may hold any elected Town office in the Town of Fulton.
No member of the Town Board of the Town of Fulton may, during his
or her term, be eligible for any Town office or Town position which,
during such term, has been created by or the selection to which is
vested in the Town Board of the Town of Fulton. Any member of the
Town Board of the Town of Fulton will be eligible for such Town office
or Town position if he or she resigns from the Town Board of the Town
of Fulton before being appointed to the Town office or Town position
and if the office or position was not created during his or her term
in office.
B.
If any question or concern by any person is raised
to the Town Board of the Town of Fulton regarding incompatibility
of any office in the Town of Fulton, the Town Attorney of the Town
of Fulton shall review the matter and shall provide his or her written
comments to the Town Board of the Town of Fulton.

The Town of Fulton will require voter registration
in accordance with the Wisconsin Statutes.
A.
Polling hours. The Town of Fulton shall have the election
polls open on election day from 7:00 a.m. to 8:00 p.m. unless the
time is extended by the Town Board of the Town of Fulton.

B.
Polling locations. The polling locations for the Town
of Fulton shall be at the Town Hall of the Town of Fulton unless designated
otherwise by the Town Board of the Town of Fulton.
C.
Election
worker shifts. Pursuant to Wis. Stat. 7.30(1), two or more sets of
officials may be selected to work different times on election days,
and the Clerk or his/her designee may establish different working
hours for different officials assigned to the same polling place.
Alternate officials shall also be appointed in a number sufficient
to maintain adequate staffing of the polling place(s).

municipal wards and combining the established wards for voting purposes.

The Town of Fulton shall require use of paper
ballots or voting machines.
