A.
There is hereby created within and for the City of West Haven a Pollution
Control Commission to be appointed by the Mayor, consisting
of five members, all of whom shall be residents of West Haven and
one of whom shall be a doctor of medicine licensed to practice in
the State of Connecticut, one a professional engineer registered in
the State of Connecticut, one shall be a representative of the industrial
community, and two shall represent the public at large. The Mayor
shall be an ex officio member of the Commission having no power to
vote except in instances where the members of the Commission present
at any meeting shall be equally divided in their vote on any matter
before it, in which case the Mayor shall cast the deciding vote to
break the tie.
B.
Within one month of the enactment of this chapter, the Mayor shall
appoint the members of said Commission, one to serve a term ending
December 31, 1968, two serving terms ending December 31, 1969, and
two serving terms ending December 31, 1970.
C.
In December of each year, beginning in 1968, the Mayor shall appoint
one or two members of said Commission, as the case may be, for terms
of three years. Any vacancy that occurs shall be filled by the Mayor
for the unexpired portion of the term.
D.
The Commission shall annually elect a Chairman from among its members,
and the Director of Pollution Control shall attend all meetings and
shall serve as secretary. The Commission shall hold meetings at least
once a month and at such other times as the Chairman may deem necessary.
E.
This Commission shall serve without compensation, except that any
necessary expenses incurred by the Commissioners in the performance
of their duties shall be paid by the city.
A.
The Commission shall, upon the recommendation of the Director of
Pollution Control and after public hearing duly warned and held, have
the power to adopt, amend and rescind such rules and regulations,
including a schedule of fees for the various permits, certificates
and services issued or rendered by the Department, as it may deem
necessary to carry out and effectuate the purposes and provisions
of the Pollution Control Ordinances.[1]
B.
The Commission shall advise and assist the Director of Pollution
Control.
A.
The Mayor shall appoint a Director of Pollution Control, who may
be compensated in the amount set by a majority vote of the City Council.
B.
The qualifications for Director shall be:
(1)
The Director shall be a high school graduate.
(2)
The Director, while in office, shall continue his education in both
water pollution control and air pollution control.
(3)
The Director shall participate in all courses concerning pollution
control that are conducted by the state agency having this authority.
(4)
The Director must meet and maintain any standards required for his
position by the state agency having this authority.
C.
The Director of Pollution control shall be responsible for the administration
and enforcement of all ordinances, rules and regulations as may be
adopted pertaining to the pollution of water and air,[1] and his duties shall include the following:
(1)
Investigation of all complaints concerning pollution of water and
air.
(2)
Development, implementation and supervision of a comprehensive program
for the testing of all bodies of water within or adjacent to the City
of West Haven.
(3)
Development, implementation and supervision of a program to evaluate
all septic tank systems presently in use in West Haven and the development
of a comprehensive program of periodic inspection of these systems.
(4)
Compilation of an inventory of water use and wastewater disposal
by West Haven industry.
(5)
Compilation of an inventory of air pollution sources.
(6)
The publication and the dissemination of information on methods of
pollution control and the enlistment of the cooperation of civic,
technical, scientific, educational and other interested organizations.
(7)
The recommendation of rules and regulations, and of amendments, additions
and modifications thereof, to the Commission for adoption by it.
