No person, firm or business shall place or have placed a rubbish
container (dumpster) on any street, highway or sidewalk in the City
of West Haven without first obtaining a permit from the Director of
Public Works pursuant to the terms and provisions of this Article
as hereinafter set forth.
A.
All contractors supplying rubbish containers (dumpsters) for placement
on any street, highway or sidewalk in the City of West Haven shall
file a bond of $500 with the Department of Public Works of the City
of West Haven. Said bond shall be good for a period of one year from
the time of filing.
B.
All rubbish containers (dumpsters) placed on any street, highway
or sidewalk in the City of West Haven shall be equipped with reflectors
to ensure the safety of vehicular or pedestrian traffic in such number
as determined by the Director of Public Works and/or his agents.
C.
The Director of Public Works and/or his agents may order that additional
equipment, such as lights, be placed on any rubbish containers (dumpsters)
in order to ensure the safety of vehicular or pedestrian traffic,
as they deem necessary.
The Director of Public Works and/or his agents, upon receipt
of a proper application from the owner of the property the rubbish
container (dumpster) is to service and an application fee of $10 and
after determining that the supplier has filed a bond as required by
§ 1196A of this Article, may issue a permit to any person,
firm or business who intends to place a rubbish container (dumpster)
on any street, highway or sidewalk in the City of West Haven.
The application for said permit shall provide the following
information:
In the event of an emergency requiring the immediate placement
of a rubbish container (dumpster) on a street, highway or sidewalk
in the City of West Haven and the Public Works Department is closed,
the owner of said property requiring said rubbish container (dumpster)
may place said container on a street, highway or sidewalk of the City
of West Haven only after reporting said emergency and registering
with the West Haven Police Department. On the first business day following
said registration with the Police Department, during which the Department
of Public Works is open, the owner of said property shall apply for
the required permit.
A.
Upon approval of the application for a permit by the Director of
Public Works and/or his agents, said permit shall be issued in triplicate.
B.
One copy shall be retained by the Department of Public Works, one
copy for the owner of the property and one copy to be supplied to
the contractor by the owner.
Any person, firm or business violating any of the provisions
of this Article shall be fined $50 for each offense, and said rubbish
container shall be subject to immediate removal at the owner's
expense. Each day the violation continues shall be deemed a separate
offense.
