A certain document, one copy of which is on file in the office of the Town and City Clerk of the City of West Haven, being marked and designated as the "International Property Maintenance Code, First Printing: December 2002," as published by the International Code Council, Inc., be and is hereby adopted as the Property Maintenance Code of the City of West Haven, in the State of Connecticut, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any prescribed in § 127-2 of this chapter.
The International Property Maintenance Code is amended and revised in the following respects:
A. 
In 101.1, Title, insert "City of West Haven."
B. 
In 102.7, Referenced codes and standards, add the following: "When reference is made to the International Building Code, International Existing Building Code, International Fire Code, International Mechanical Code, International Plumbing Code, ICC Electrical Code or the International Zoning Code, it is to be assumed that the reference is to the current State Building Code that is adopted during the time of enforcement."
C. 
In 103.5, Fees, insert "$0.50 a copy for any requested document in the Property Maintenance files."
D. 
In 302.4, Weeds, insert: "eight inches."
E. 
In 304.14, Insect screens, delete "During the period from [date] to [date]." Start sentence with: "Every."
F. 
In 602.3, Heat supply, delete "During the period from [date] to [date]" and replace "69° F." with "65° F."
G. 
In 602.4, Occupiable work spaces, delete "During the period from [date] to [date]."
H. 
In 602.5, Room temperature measurement, delete "and two feet (610 mm) inward from the center of each existing wall."
I. 
In 605.2, Receptacles, amend in part "Every bathroom shall contain at least one ground-fault circuit interrupter protected receptacle. Every kitchen counter receptacle shall be ground-fault interrupter protected."
J. 
In Chapter 8, delete the listed Code references and substitute with "The current State Building Code."
K. 
In 106.2 add the sentence: "Citations shall be served in accordance with Section 112."
L. 
Add Section 112 Citations to read as follows:
112.1 Citation. Violations of this Code may also be subject to citation by the Code Official.
112.2 Procedure. The procedure for citation and appeals shall be the procedures specified in Chapter 128 of the Code of the City of West Haven, Enforcement of Ordinances.
112.3 Penalties. The penalty for violation of the provisions of this Code for which a citation is issued shall be a fine of $100 per violation. Each day the violation continues following the issuance of the citation shall constitute a separate violation and is subject to an additional fine of $100 per day. The penalties established by this chapter shall not be exclusive to any other enforcement remedy which may be imposed by the Code Official or his/her agent for violations of the West Haven Property Maintenance Code as authorized by state statute, ordinance or the West Haven Property Maintenance Code.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any circuit court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance prior to the adoption of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
The Clerk of the West Haven City Council shall certify to the adoption of this chapter and cause the same to be published as required by law, and this chapter shall take effect and be in force after the passage by the City Council and 30 days after being signed by the Mayor of the City of West Haven.
