The Mayor, subject to approval by a resolution of the Borough Council, may appoint special law enforcement officers for a term not exceeding one year. Nothing herein shall be construed to require reappointment upon the expiration of the term. The special law enforcement officers so appointed shall not be members of the Borough's police force and their powers and duties as determined pursuant to this article shall cease at the expiration of the term for which appointed.
A special law enforcement officer may be removed for cause after an adequate hearing, unless the appointment is for four months, or less, in which event, the appointment may be revoked without cause or hearing.
Special law enforcement officers shall carry out their duties and responsibilities under the direct supervision of the Chief of Police, and their powers, rights and duties shall be specifically defined by the Chief of Police. The Chief of Police may assign any such duties permitted by N.J.S.A. 40A:14-146.14. These powers, rights and duties, however, shall immediately cease at the expiration of the term for which the special law enforcement officers were appointed, or upon revocation of their appointment. The special law enforcement officers shall not carry a firearm or other weapon at any time except as otherwise directed by the Chief of Police and in accordance with state law. The resolution approving appointment of special law enforcement officers shall designate the rate of pay, if any, in accordance with the provisions of this section.
Pursuant to N.J.S.A. 40A:14-146.10, no person shall be appointed as a special law enforcement officer unless, at the time of his or her appointment, he or she is a resident of the State of New Jersey and a citizen of the United States; is able to read, write and speak the English language well and intelligently; has a high school diploma or its equivalent; is sound in body and of good health; is of good moral character; and has not been convicted of any offense involving dishonesty or which would make him or her unfit to perform the duties of the office. Every such special law enforcement officer shall be fingerprinted and his or her fingerprints shall be filed with the Division of the State Police and Federal Bureau of Investigation. Reports shall be made by the Chief of Police to the Borough Council concerning the eligibility and qualifications of any person proposed to be appointed a special law enforcement officer.
A. 
Class One. Officers of this class shall be authorized to perform routine traffic detail, spectator control and similar duties. Class One officers shall have the power to issue summonses for disorderly persons and petty disorderly persons offenses, violations of municipal ordinances and violations of Title 39 of the Revised Statutes. The use of a firearm by an officer of this class shall be strictly prohibited and no Class One officer shall be assigned any duties which may require the carrying or use of a firearm.
B. 
Class Two. Officers of this class shall be authorized to exercise full powers and duties similar to those of a permanent, regularly appointed full-time police officer. The use of a firearm by an officer of this class may be authorized only after the officer has been fully certified as successfully completing training as prescribed by the Police Training Commission.
C. 
In accordance with N.J.S.A. 40A:14-146.17, a total of no more than three Class One and no more than two Class Two special law enforcement officers may be appointed by the Mayor and Council.

Special law enforcement officers appointed by the Borough of Red Bank shall receive a rate of pay that is within the ranges established by the Mayor and Council. The actual salary paid each special law enforcement officer shall be set forth in the resolution appointing each individual to the position.
No special law enforcement officer may be employed for more than 20 hours per week by the Borough, except that they may be employed by the Borough for those hours as the Mayor and Council may determine necessary in accordance with the limits prescribed in N.J.S.A. 40A:14-146.16. Notwithstanding any provision of this section to the contrary, special law enforcement officers may be employed only to assist the Red Bank Police Department, but may not be employed to replace or substitute for full-time, regular police officers or in any way diminish the number of full-time officers employed by the Borough.
