[HISTORY: Adopted by the Township Committee of the Township of Quinton 11-6-1985 by Ord. No. 1985-5. Amendments noted where applicable.]
Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383),[1] the New Jersey Uniform Fire Code shall be locally enforced in the municipality of Quinton Township.

The local enforcing agency shall be the Bureau of Fire Prevention, a department of the "Company."
The Bureau of Fire Prevention shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of Quinton Township, other than owner-occupied one- or two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The Bureau of Fire Prevention shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The Bureau of Fire Prevention shall be under the direct supervision and control of the Fire Official, whose appointment, term of office and removal are described in § 131-6 hereafter.
A. 
Appointment of Fire Official. The Fire Official shall be appointed by the Township Committee of Quinton.
B. 
Term of office. The Fire Official shall serve for a term of one year from the date of appointment, and, in the event that a vacancy shall occur during such term, the same shall be filled by an individual appointed by the Township Committee of Quinton for the unexpired term.
C. 
Inspectors and employees. Such inspectors and other employees as may be necessary to enforce this chapter shall be appointed by the Township Committee of Quinton.
D. 
Removal from office. Inspectors and other employees of the Bureau of Fire Prevention shall be subject to removal by the Township Committee upon the recommendation of the Fire Chief of the "Company" for inefficiency or misconduct. Each inspector or employee recommended to be removed shall, prior thereto, be afforded an opportunity to be heard by the Township Committee of Quinton or a designated hearing officer.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the Bureau of Fire Prevention shall have the right to appeal to the Construction Board of Appeals of Salem County.
The permit fees established by the Uniform Fire Code shall be as follows:
A. 
Type 1: $25.
B. 
Type 2: $100.
C. 
Type 3: $200.
D. 
Type 4: $300.
E. 
Type 5: $1,000.

A. 
No person or persons shall make or cause to be made any open fire or bonfire of any kind or burn any type of combustible materials whatsoever within the Village Residential Zone of the Township of Quinton except for cooking purposes or indoor fireplaces, incinerators or furnaces, unless approved by the Fire Official or his designee or otherwise permitted by regulations promulgated by the State of New Jersey.
B. 
Nothing stated in § 131-9A of this chapter shall preclude the use of chimineas or outdoor fireplaces within the Village Residential Zone. Chimineas and outdoor fireplaces used within the Village Residential Zone are subject to the following restrictions. These devices shall not be used:
(1) 
On a combustible deck or patio.
(2) 
On balconies or breezeways of apartments or multifamily dwellings.
(3) 
If winds are in excess of 15 miles per hour.
(4) 
To burn materials other than dry seasoned firewood.
(5) 
Closer than 25 feet to any building or structure.

For purposes of Chapter 131 of the Code of the Township of Quinton, the following definitions shall apply:
BONFIRE
An outdoor fire utilized for ceremonial purposes.
OPEN FIRE
The burning of any materials wherein the products of combustion are emitted directly into the ambient air without passing through a stack or chimney from an enclosed chamber. For the purpose of this definition, a chamber shall be regarded as enclosed when, during the time combustion occurs, only apertures, ducts, stacks, flues or chimneys necessary to provide combustion air and permit the escape of exhaust gas are open.

In addition to the enforcement provisions set forth in this chapter, any person or entity whom shall violate any provision of this chapter, shall, upon conviction thereof, be punished by a fine of no less than $100 and no more than $2,000, or by imprisonment for a term not to exceed 90 days or by a period of community service not to exceed 90 days. Any person who is convicted of violating any provision of this chapter within one year of the date of a previous violation of this same chapter and who was fined for the previous violation, shall be sentenced by a court to an additional fine as a repeat offender. The additional fine imposed by the court upon a person for a repeated offense shall not be less than the minimum or exceed the maximum fine fixed for a violation of this chapter, but shall be calculated separately from the fine imposed for the violation of this chapter.
