In the event of noncompliance with the provisions of this chapter, the Enforcement Officer may issue an appearance ticket, returnable to the Town of Amenia Justice Court at a date and time as specified on the appearance ticket. The appearance ticket shall specify the alleged violation, date and time thereof, and a description of the junk or abandoned vehicle, junk trailer, junk farm equipment, appliance, rubbish or debris involved. A copy of the appearance ticket shall be forwarded to the Town Justice and shall be accompanied by any information detailing the violation.
A. 
Any person who shall violate this chapter or any of the provisions hereof or who shall fail or refuse to comply with the provisions of any written notice herein provided for or who shall refuse to remove any junk or abandoned vehicle, junk trailer, junk farm equipment, appliance, rubbish or debris as directed by this chapter or who shall resist or obstruct the duly authorized officer, agent or employees of the Town in the removal or disposition thereof shall, upon conviction, be subject to a fine of not to exceed $250 or a jail sentence of not more than 15 days, or both, for each violation, and each 24 hours during which said violation shall continue shall constitute a separate and distinct violation within the meaning of this chapter.
B. 
A violation of this chapter shall also subject the violator to a civil penalty of the greater of $100 per separate violation or the Town's costs of inspection, service of notices, removal, towing and permanently disposing of such vehicle, less any criminal monetary fine which may have been imposed.
No officer, agent or employee of the Town of Amenia shall be personally liable for any damage that may accrue to persons or property as a result of any act required or permitted in the discharge of his or her duties under this chapter. Any suit brought against any officer, agent or employee of the Town of Amenia as a result of any act required or permitted in the discharge of his duties under this chapter shall be defended by the Town Attorney until the final determination of the proceeding thereon.
