Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this Part for any person to park a vehicle or allow it to remain parked otherwise.

Parking shall be prohibited at all times in the following locations:
1. 
Generally, no parking or standing:

A. 
Within 30 feet of a traffic signal, stop sign or yield sign.
B. 
Within 25 feet of the bisect line of an intersection not controlled by one of the above.
C. 
Within 15 feet of a fire hydrant.
D. 
In a bus stop.
E. 
On a sidewalk; in or on a painted crosswalk.
F. 
In a fire lane.
G. 
Obstructing access to a driveway or garage.
H. 
Double parking or obstructing a roadway/traffic-way/bike lane.
I. 
Upon a bridge or within a tunnel.
J. 
Where official signs prohibit parking, stopping, or standing.
K. 
During street sweeping hours.
L. 
Parked facing the wrong direction (includes back-in angle, wrong side of street and wrong way on one-way street).
M. 
Parked within 20 feet of a painted crosswalk.
N. 
Not parked within 12 inches of the curb.

1. 
No person shall park or leave unattended a vehicle on private property without the consent of the owner or other person in control or possession of the property, except in the case of emergency or disablement of the vehicle, in which case the operator shall arrange for the removal of the vehicle as soon as possible and in addition shall notify the Pottstown Police Department of all relevant information, including the conditions causing the emergency or disablement.

The owner or other person in charge or possession of any property on which a vehicle is parked or left unattended in violation of the provisions of this section may have the vehicle removed by a licensed towing service at the reasonable expense of the owner of the vehicle. Such person who removes a vehicle left parked or unattended in violation of the provisions of this section shall have a lien against the owner of the vehicle, in the amount of the reasonable value of the costs of removing the vehicle.
3. 
The provisions of this section shall not apply to private parking lots unless such lots are posted to notify the public of any parking restrictions and the operator of the vehicle violates such posted restrictions. For the purposes of this section, "private parking lot" means a parking lot open to the public or used for parking without charge or a parking lot used for parking with charge.

In order to ensure access to parking spaces on public streets, including alleys, all vehicles and equipment must be moved or removed periodically in accordance with the following regulations:
A. 
Seasonal vehicles and equipment.
(1) 
Summer seasonal-use vehicles and equipment are permitted to occupy a parking space on any public street between the dates of April 15 and October 15, provided that the vehicle or equipment is removed from the parking space at least twice for a period of not less than 24 hours each during every month:
(a) 
Camping trailers, motor homes, or recreational vehicles;
(b) 
Boats and other watercraft and trailers used for watercraft, regardless of whether a boat or watercraft is stored on the trailer;
(c) 
Trailers used to transport or store vehicles, animals, tools or equipment;
(d) 
Racing vehicles, including cars, trucks, dragsters, stock cars, quarter midgets and go-carts;
(e) 
Equipment used for construction, maintenance, and repair of buildings, roads and vegetation; and
(f) 
Other items generally considered summer seasonal use or purpose.
(2) 
Any vehicle, trailer or piece of equipment not generally considered summer seasonal use or purpose is not permitted to be placed on any public street or alley between the dates of April 15 and October 15 for more than four days in any thirty-day period.
(3) 
Winter seasonal-use vehicles and equipment are permitted to occupy a parking space on any public street between the dates of October 15 and April 15, provided that they are removed from the parking space at least twice for a period of not less than 24 hours each during every month:
(a) 
Snowplows and other snow-removal equipment;
(b) 
Winter recreational vehicles and equipment;
(c) 
Trailers used to transport snow-removal equipment or winter recreational vehicles and equipment; and
(d) 
Other items generally considered winter seasonal use or purpose.
(4) 
Any vehicle, trailer or piece of equipment not generally considered winter seasonal use or purpose is not permitted to be placed on any public street or alley between the dates of October 15 and April 15 for more than four days in any thirty-day period.
B. 
Nonseasonal vehicles and equipment.
(1) 
Storage containers and trash containers/dumpsters may be placed upon any public street or alley at any time during the year in compliance with the regulations of this Part if the person(s) responsible for the container has first obtained a permit from the Borough and has paid the necessary permit fee.
(a) 
The permit application must provide the exact location of the container/dumpster and the time period in which it will be located on a public street or alley, both of which will require review and approval of the Borough Police Department prior to the issuance of a permit.
(2) 
Trailers and other equipment used for business operations by contractors, plumbers, landscapers, and other similar uses may be positioned in a legal parking space at any time during the year, provided that the trailers or other equipment be removed a minimum of two times per week.

1. 
Purpose and Findings. The primary purpose of residential permit parking is to make every reasonable effort to accommodate residents living in areas of the Borough that have a mix of business, office and residential uses which would ordinarily result in parking restrictions that would not occur in a predominantly residential area. These restrictions include time limits and other regulations during the hours when businesses are normally open in the areas of the "Downtown" (center of town) where many business and other nonresidential uses are located. The Borough further finds that:
A. 
Certain residential areas in the Borough are subjected to commuter vehicle parking, therefore depriving the residents of those areas of spaces in which to park their own vehicles.
B. 
Those residential streets are also subjected to a high degree of commuter traffic, which substantially reduces the quality of the ambient air level.
C. 
The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Borough considers it to be in the interest of the people of the Borough to provide for the establishment of a residential permit parking program to insure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.
D. 
Certain older residential areas in the Borough have no parking available except on Borough-owned property. The Borough desires to attempt to provide some limited accommodation for those persons residing in the immediate vicinity of the Borough-owned property who have no available parking area.

E. 
Certain residential areas in the Borough near the Hill School's athletic fields are negatively impacted by the parking of patron vehicles for events on those athletic fields. In order to provide some relief to the affected residents during these events, parking will be restricted to the residents and invited guests on certain designated streets.

2. 
Definitions. For purposes of this section, words and terms listed in the above section, as follows, shall have the following meanings:
BONA FIDE OCCUPANCY
In good faith; without fraud — occupying; taking, keeping or holding in possession; or being an occupant.
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area.

A parking area which is not in the right-of-way of a public street or alley, associated with any property or building within the residential permit parking area, which can accommodate one or more vehicles, regardless of whether any costs are associated with the ability to park in this area.
PARKING CATEGORY
A type of use contained within the property or building:
A. 
Category 1 is a business enterprise or professional office.
B. 
Category 2 is a resident, religious facility or nonprofit agency.
PARKING ZONE
A street or portion of a street where permanent time-limit parking restrictions have been imposed. Currently, three parking zones exist:

A. 
Within the PDIDA District (defined as High Street; between York Street and Evans Street, Hanover Street, between High Street and King Street, Charlotte Street, between Queen Street and King Street).
B. 
Outside the PDIDA District (defined as High Street, between Manatawny Street and York Street, High Street, between Evans Street and Madison Street, King Street, between Manatawny Street and Franklin Street, York Street, between High Street and King Street, Hanover Street, between King Street and Beech Street, Evans Street, between Queen Street and King Street).
C. 
Borough-owned property (defined as designated parking areas on Borough-owned public parks, or other Borough property).
D. 
Borough streets utilized by patrons of the Hill School athletic fields.

PROPRIETOR
A person who owns or leases real estate within a residential permit area (outside the PDIDA District) of which he/she is not a resident, but who owns or manages (or designees of said person) the business enterprise, professional office, religious facility, or nonprofit agency maintained at that address. A proprietor shall be entitled to a limited number of parking spaces for that business, professional office, religious facility, or nonprofit agency.
RESIDENT
A person who owns or leases real property within a residential permit area and who maintains either a voting residence or a bona fide occupancy, or both, at that address.
RESIDENTIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and non-business property (such as schools, parks, places of worship, hospitals and nursing homes).
3. 
Criteria. The residential areas designated in Subsection 4 of this section are those deemed impacted and hence eligible for residential permit on the basis of the following criteria:
A. 
During any period between the hours of 8:00 a.m. to 8:00 p.m., Monday through Saturday, except legal holidays, due to the mix of residential and nonresidential uses, there are a significant number of vehicles that utilize the on-street parking capacity of that area. For the purpose of this criteria, a legal parking space shall be defined as 20 linear feet.
B. 
During the same period as specified in Subsection 3A, directly above, there are significant identifiable vehicles parked (or standing) on the street in the area that are not registered in the name of a person residing in the area.
Provided: in determining that a specific area identifiable as impacted and eligible for residential permit parking is designated as a residential permit parking area, the following factors are taken into consideration:
(1) 
The local and metropolitan needs with respect to clean air and environment;
(2) 
The possibility of a reduction in total vehicle miles driven in the Borough;
(3) 
The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards;
(4) 
The proximity of public transportation to the residential area;
(5) 
The desire and need of the residents for residential permit parking and their willingness to bear the administrative costs in connection with it; and
(6) 
The need for parking in excess of the residential permit parking program in proximity to establishments located in the residential permit parking area and used by the general public for religious, health or educational purposes.
4. 
Designation of Residential Permit Parking Areas.

B. 
Signs shall be erected along the streets in each residential permit parking area, indicating the days, hours, locations, and conditions under which certain parking shall be permitted by permit only. Holders of a residential parking permit shall be permitted to park in the designated parking zone (except handicap parking spaces) in excess of three hours, except that the parking restrictions on York Street between Buttonwood Alley and King Street and Charlotte Street shall be for 30 minutes only.
C. 
In addition to the op-street areas described in Subsection 4A above, the following areas are designated as alternative parking areas as set forth below:

5. 
Application for Permit. Application for a residential parking permit shall be made to the Chief of Police or his designee by the person desiring the permit, who shall be only the owner or driver of a motor vehicle who is defined as a proprietor or resident and is able to demonstrate no use or availability of any off-street parking space for the vehicle to be permitted. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, set pursuant to a resolution of Borough Council. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the name of the business office or nonprofit, as the case may be; the address of the resident or the proprietor, as the case may be; the make, model, color and registration number of the motor vehicle; and the driver number as taken from the applicant's current driver's license. At the discretion of the Chief of Police or his designee, the applicant shall be required, at the time of making application, to present his driver's license and vehicle registration card. The Pottstown Police Department, in conjunction with the Borough Manager, or their authorized agent or expressly authorized designee, are hereby empowered to establish rules and regulations to effectuate the provisions of this residential permit parking section.

6. 
Issuance of Permit. Upon receipt of the application and permit fee, if any, and determination by the Pottstown Borough Police Department that the information upon the application shows that the applicant is entitled to a residential parking permit, the Borough shall issue to the applicant the applicable residential parking permit, which shall be valid for the appropriate applicable time period. The permit shall display the permit number, the license number(s) of the permitted vehicle(s) printed on it, as well as the expiration date and the renewal date. The permittee shall have the right to park the permitted vehicle on any public street, in any legal parking space, within the appropriate designated parking category and parking zone where the residential parking restrictions exist.
7. 
Temporary and Exempt Parking Permits. Temporary parking permits may be issued by the Borough for up to seven days (168 hours in duration), upon payment of a fee established pursuant to a resolution, to bona fide visitors of residents of a designated residential permit parking area; and exemption parking permits may be issued without payment of a fee to handicapped persons.
8. 
Responsibility of Permit Holder.
A. 
Notwithstanding any provisions of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him/her in the designated residential permit parking area during those times when parking of a motor vehicle is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit is required to be displayed, hanging from the front inside rear-view mirror only, with the vehicle license numbers facing outward. Any vehicle having a mirror which cannot hold a permit must have velcro used to attach the permit to the back of the mirror (providing velcro is the vehicle owner's responsibility). If the vehicle has no inside rear-view mirror, the vehicle owner is responsible to improvise such that the permit hangs near the center of the windshield. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential parking area.
B. 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than a residential permit parking regulation or restriction in the appropriate designated residential parking area.
C. 
No person other than the permit holder whose vehicle license plate number(s) appears on the permit shall use a residential parking permit or display it on any other vehicle operated. Any such use or display by a person other than the permit holder, for the vehicle issued, shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
D. 
As a condition of the permit, the permit holder understands that any vehicle parked outside its assigned zone and displaying the wrong color permit is in violation of this section. Any permitted vehicle parked for more than three hours without displaying the proper permit is also in violation. Any permitted vehicle parked in an alternative location, without displaying the proper permit, is in violation. Any vehicle parked in the wrong area of an alternate location is in violation. Any permitted vehicle not displaying the proper permit is in violation. Any permitted vehicle not displaying the proper permit hanging from the rear-view mirror (or center of the windshield) is in violation.
E. 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Chief of Police in order to obtain a residential parking permit.
9. 
Revocation of Permits. The Chief of Police or his designee shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to him of the revocation, the permit holder shall surrender the permit to the Chief of Police or his designee. Failure to do so, when so requested, shall constitute a violation of this section, provided that any person receiving such a notice may, within 10 days after the date of the notice, appeal to Borough Council for a hearing on the revocation, and the decision of Borough Council shall be final.
10. 
Permit Application Fees Established.
A. 
There are hereby established the following residential permit parking application fees, under which the residential permit parking area shall be divided into two zones: the PDIDA District Zone and Outside the PDIDA District Zone. The PDIDA District consists of High Street, from York Street to South Evans Street, Hanover Street, from High Street to King Street, and Charlotte Street, from Queen Street to King Street. The specific areas are designated by the PDIDA map, which is incorporated herein. Each zone is further divided into two categories, as follows: Category 1, business or office; and Category 2, resident or nonprofit.
(1) 
Within the PDIDA District, business or office permits shall only be available and utilized to allow monthly parking in a municipal lot at the municipal parking lot rate. For residents or nonprofits in the PDIDA District, a maximum of two permits per resident or nonprofit can be issued at the following rates:
(a) 
First permit: $1.50 per week ($78 per year).
(b) 
Second permit: $4 per week ($208 per year), or each resident or nonprofit can share one permit between a maximum of two vehicles, for one at a time.
(c) 
Visitor permits: $2.50 per day for up to four days or $15 per each consecutive seven-day period (periods longer than seven days will be charged in seven-day increments).
(d) 
Residents over age 60 will receive a 50% discount but must show proof of age and proof of residency.
(e) 
Regular residential permits must be purchased in advance in time frames of 26 weeks or 52 weeks.
(f) 
Parking permits can only be used for parking of routinely operated vehicles, not vehicles which are infrequently utilized.
(g) 
Year two: First permit will increase to $1.75 per week ($91 per year). Second permit will increase to $4.50 per week ($234 per year).
(2) 
Parking outside the PDIDA District, business or office:
(a) 
First permit: $1 per week ($52 per year).
(b) 
Each additional permit: $2 per week ($104 per year), or each business or office can share one permit between a maximum of four vehicles, for one at a time.
(c) 
Regular residential permits must be purchased in advance in time frames of 26 weeks or 52 weeks.
(d) 
Year two: First permit will increase to $1.50 per week ($78 per year). Additional permits will increase to $2.75 per week ($143 per year).
(3) 
Parking outside the PDIDA District, residence or nonprofit.
(a) 
First permit: $0.50 per week ($26 per year). Each additional permit: $1 per week ($52 per year), or each residence or nonprofit can share one permit between a maximum of two vehicles, for one at a time.
(b) 
Visitor permits: $1.50 per day for up to four days or $9 per each consecutive seven-day period. Periods longer than seven days will be charged in seven-day increments.
(c) 
Residents over age 60 will receive a 50% discount; must show proof of age and proof of residency.
(d) 
Regular residential permits must be purchased in advance in time frames of 26 weeks or 52 weeks.
(e) 
Parking permits can only be used for parking of routinely operated vehicles, not vehicles which are infrequently utilized.
(f) 
Year two: First permit will increase to $0.60 per week ($31.20 per year). Additional permits will increase to $1.25 per week ($65 per year).
(g) 
Permits for parking on Borough-owned property shall be at the same rate as fees for the area in which the property is located. For these areas, an equitable system for permitting shall be developed between the Police Department and the other Borough department overseeing that specific Borough property.

(h) 
Permits for parking on Borough streets affected by patrons of Hill School athletic fields shall be free of charge. For these areas, an equitable system for permitting shall be developed by the Police Department.

B. 
All future changes to residential permit parking fees established in this section shall be made, from time to time, by resolution of the Pottstown Borough Council.

Editor's Note: This ordinance also provided that it shall become effective immediately upon enactment. However, the specific requirements shall not take effect for enforcement purposes until July 1, 2008. Beginning February 1, 2008, any resident or proprietor, as herein defined, who wishes to participate in the newly enacted residential permit parking program as set forth in this ordinance may do so on a voluntary basis, under rules and regulations established by the Pottstown Police Department.

1. 
Any person who commits a violation of § 402, Subsection 1A, B or C, upon conviction, shall be sentenced to pay a fine of $30 and costs of prosecution and, in default of said fine and costs, to undergo imprisonment for not more than five days.
2. 
Any person who commits a violation of § 401, Subsection 1K, or § 404, upon conviction, shall be sentenced to pay a fine of $40 and costs of prosecution and, in default of said fine and costs, to undergo imprisonment for not more than five days.
3. 
Any person who commits a violation in any residential parking zone pursuant to § 409 shall, upon conviction, be sentenced to pay a fine of $30 and costs of prosecution and, in default of said fine and costs, to undergo imprisonment for not more than five days.
4. 
Any residential parking permit holder who fails to properly display his/her residential parking permit as required by § 409, Subsection 8A, of this Part shall be required to pay an administrative charge of $5.
5. 
Any person who commits a violation of § 402, Subsection 1E, F, G or H, or § 402.1, upon conviction, shall be sentenced to pay a fine of $50 and costs of prosecution and, in default of said fine and costs, to undergo imprisonment for not more than five days.
6. 
Any person who commits a violation of § 405 regarding three-hour time limit parking shall, upon conviction, be sentenced to pay a fine of $20 and costs of prosecution and, in default of said fine and costs, to undergo imprisonment for not more than five days.
7. 
Any person who commits a violation of § 402, Subsection 1N, upon conviction, shall be sentenced to pay a fine of $15 and costs of prosecution and, in default of said fine and costs, to undergo imprisonment for not more than five days.
8. 
The owner or responsible party of any nonseasonal vehicle and/or equipment who commits a violation of § 406.1, Subsection B(1), upon conviction, shall be sentenced to pay a fine as follows:
A. 
The first offense will be double the amount of the daily permit fee, based on the size of the container or dumpster which has been placed on the street.
B. 
A second or subsequent offense will be triple the amount of the daily permit fee, based on the size of the container or dumpster which has been placed on the street, and may be assessed daily until a permit is obtained.
9. 
Any person who violates any other provision of this Part shall, upon conviction, be sentenced to pay a fine of $25 and costs of prosecution, provided that it shall be the duty of the police officers and of parking enforcement personnel in the Borough to report to the appropriate official all violations of any provision of this Part, indicating in each case the section violated, the license number of the vehicle involved in the violation, the location where the violation took place, and any other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle notice stating that the vehicle was parked in violation of this Part. The notice shall contain instructions to the owner or driver of the vehicle that if he or she shall report to the police headquarters of the Borough of Pottstown and pay, for the use of the Borough, the sum of $25 within 20 days after the time of such notice, the same shall save the violator from prosecution and from the payment of fines and costs hereinafter provided and, in default of said fine and costs, to undergo imprisonment for not more than five days. The failure of said owner or operator to make the payment of $25 as herein provided at the police headquarters of the Borough of Pottstown within 20 days shall render the owner or operator subject to penalties as described hereinbefore for such violation of the provisions of this Part.
