Warminster Township hereby elects to administer and enforce
the provisions of the Pennsylvania Construction Code Act, Act 45 of
1999, 35 P.S. §§ 7210.101 through 7210.1103, as amended
from time to time, and its regulations.

The Uniform Construction Code, contained in 34 Pa. Code Chapters
401 through 405, as amended from time to time, is hereby adopted and
incorporated herein by reference as the Municipal Building Code of
Warminster Township.

Administration and enforcement of the code within Warminster
Township shall be undertaken in any of the following ways, as determined
by the Board of Supervisors of Warminster Township from time to time
by resolution:
A.
By the designation of an employee of Warminster Township to serve
as the municipal code official to act on behalf of Warminster Township;
B.
By the retention of one or more construction code officials or third-party
agencies to act on behalf of Warminster Township;
C.
By agreement with one or more other municipalities for the joint
administration and enforcement of this Act through an intermunicipal
agreement;
D.
By entering into a contract with another municipality for the administration
and enforcement of this Act on behalf of Warminster Township;
E.
By entering into an agreement with the Pennsylvania Department of
Labor and Industry for plan review, inspections and enforcement of
structures other than one-family or two-family dwelling units and
utility and miscellaneous use structures.

A Board of Appeals shall be established by resolution of the
Board of Supervisors of Warminster Township in conformity with the
requirements of the relevant provisions of the code, as amended from
time to time, and for the purposes set forth therein. If at any time
enforcement and administration is undertaken jointly with one or more
other municipalities, said Board of Appeals shall be established by
joint action of the participating municipalities.

All relevant ordinances, regulations and policies of Warminster
Township not governed by the code shall remain in full force and effect.

Fees assessable by Warminster Township for the administration
and enforcement undertaken pursuant to this Part 1 and the code shall
be established by the Board of Supervisors by resolution from time
to time.

1.
Section 403.42(c)(1)(v) of the Uniform Construction Code, 34 Pa.
Code, § 403.42(c)(1)(v), is amended to read as follows:
(v)

Sidewalks and driveways not more than 30 inches above grade and that are not located over a basement or story below it and which are not part of an accessible route. Sidewalk, curb and driveway aprons that are located within a Warminster Township right-of-way shall meet the requirements of Chapter 21, Part 1, of the Code of Warminster Township.

Section 403.42(f) of the Uniform Construction Code, 34 Pa. Code,
§ 403.42(f), is deleted in its entirety.

Section 403.42a(b) of the Uniform Construction Code, 34 Pa. Code
§ 403.42a(b), is amended to read as follows:
(b)

A permit applicant shall submit an application to the Building
Code Official and attach construction documents, including plans and
specifications and information concerning special inspection and structural
observation programs, Department of Transportation highway access
permits and other data required by the Building Code Official, with
the permit application. A permit applicant must apply for and obtain
a zoning permit prior to submitting an application to the Building
Code Official. An approved zoning permit and/or decision of the Zoning
Hearing Board must be submitted with the building permit application.
If the building or buildings for which the permit is sought requires
subdivision and/or land development approval, the applicant must obtain
the approval of all applicable federal, state, and local boards, commissions
and agencies and execute the required financial security agreements
prior to submitting the permit application. The applicant must submit
a current license from Warminster Township and a valid certificate
of insurance from the contractor that is to perform the work for which
the permit is sought. The applicant shall submit two sets of documents
when the Department conducts its review.

Section 403.42a(h)(5) of the Uniform Construction Code, 34 Pa. Code
§ 403.42a(h)(5), is amended to read as follows:
(v)

If the construction involves demolition, the site plan shall
indicate construction that is to be demolished and the size and location
of existing structures and construction that will remain on the site
or plot. A demolition permit is required prior to demolition, and
a certificate from an exterminator providing proof that the building
to be demolished has been inspected and treated, if necessary, for
infestation of insects, rodents and other pests must be submitted
with the demolition permit application.

Section 403.42a(m) of the Uniform Construction Code, 34 Pa. Code.
§ 403.42a(m), is deleted in its entirety.

Section 403.46(b) of the Uniform Construction Code, 34 Pa. Code § 403.46(b),
is hereby amended to read as follows:
(b)

A Building Code Official shall issue a certificate of occupancy
within 15 business days after receipt of a final inspection report
that indicates compliance with the Uniform Construction Code. The
certificate of occupancy shall contain the following information:

The permit number and address of the building, structure or
facility.
| ||
(2)
|
The permit holder's name and address.
| ||
(3)
|
A description of the portion of the building, structure or facility
covered by the occupancy permit.
| ||
(4)
|
The name of the Building Code Official who issued the occupancy
permit.
| ||
(5)
|
The applicable construction code edition applicable to the occupancy
permit.
| ||
(6)
|
The use and occupancy classification under Chapter 3 (Use and
Occupancy Classification) of the International Building Code, when
designated.

(7)
|
The type of construction defined in Chapter 6 (Types of Construction) of the International Building Code, when designated.
| ||
(8)
|
Special stipulations and conditions relating to the permit and
Board of Appeals' decisions and variances for accessibility requirements
granted by the Secretary.

|
The date of the final inspection.

Section 403.62a(b) of the Uniform Construction Code, 34 Pa. Code
§ 403.62a(b), is hereby amended to read as follows:
(b)

Section 403.65(b) of the Uniform Construction Code, 34 Pa. Code,
§ 403.65(b), is amended to read as follows:
(b)

The name of the Building Code Official who issued the occupancy
permit.

|
The construction code edition applicable to the occupancy permit.

(7)
|
If an automatic sprinkler system is provided.

9.
Notwithstanding any provisions of the Commonwealth of Pennsylvania
Uniform Construction Code, as adopted, and the Code of Warminster
Township, Bucks County, Pennsylvania, the Warminster Township Municipal
Authority shall have the right to inspect construction of all water
and sanitary sewer facilities within Warminster Township in accordance
with its current rules and regulations.
10.
All provisions of the Commonwealth of Pennsylvania Uniform Construction
Code, as adopted, and the Code of Warminster Township, Bucks County,
Pennsylvania, that are unaffected by the provisions of this Part 1
are hereby declared to be in full force and effect. Any provisions
of the Code of Warminster Township, Bucks County, Pennsylvania, inconsistent
herewith are hereby repealed to the extent of the inconsistency.

Section 403.1(b)(3) of the Uniform Construction Code, 34 Pa. Code
§ 403.1(b)(3), is hereby deleted in its entirety.
2.
All utility and accessory structures constructed within Warminster
Township with a building area greater than 144 square feet shall comply
with the provisions of the Commonwealth of Pennsylvania Uniform Construction
Code, as adopted and amended, and shall require a permit prior to
construction.

Section 104(b)(8)(v) of the Uniform Construction Code, 35 P.S. § 7210.104(b)(8)(v),
is hereby deleted in its entirety.

2.
All temporary structures that are over 200 square feet in size or
are erected on nonresidential properties that are exempted under 35
P.S. §§ 7210.104(b)(8) shall comply with the flame
propagation criteria of the applicable edition of NFPA No. 701, the
ICC Electrical Code, and the International Fire Code criteria as to
the number of portable fire extinguishers.
