Any user who is found to have violated an order of the Authority or who failed to comply with provisions of this Part 1, Articles A through F, and the orders, rules, regulations and permits issued hereunder, shall be fined no less than $300 nor more than $1,000 for each offense. Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense. All fines and penalties shall be paid directly to the Authority and are civil in nature. In addition to the penalties provided herein, the Authority may recover any expenses it may have incurred in determining that the user is a violator of this Part 1, Articles A through F, including but not limited to costs related to investigating, sampling and analyzing the violation. Furthermore, the Authority is entitled to recover expenses of litigation, including reasonable attorney's fees, court costs, court reporter's fees, fees of professionals and experts and other expenses of litigation.

In addition to the penalties in this Part 1, Articles A through F, the Authority has been empowered by PA Act 9 of 1992 (35 P.S. § 752.4) to levy civil penalties of up to $25,000 per day for each occurrence.

Any user who is found to have willfully or negligently failed to comply with a provision of this Part 1, Articles A through F, may be subject to criminal penalties of up to one year in prison, fines, or both.

Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this Part 1, Articles A through F, or its wastewater discharge permit, or who falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method required under this Part 1, Articles A through F, shall upon conviction, be punished by a fine of not more than $1,000 or by imprisonment for not more than 30 days or by both and, at the discretion of the Authority, by permanent severance of sewage service.
