No water shall be provided for internal or external use to any residential, commercial, industrial, agricultural, recreational, governmental, or public building or structure of any kind which is constructed or remodeled and in which plumbing, water piping or water fixtures are to be installed, extended or altered in any way, and for which construction a permit is required to be obtained from the Township (or would be required but for an exemption from a permit requirement for public or governmental agencies) unless the new, extended or altered plumbing, water piping and other water using fixtures therein conform to the requirements and standards of § 26-202 of this Part 2A. The provisions of this Part 2A shall apply to any such building or structure for which such a building permit is issued, or would otherwise be required to be issued but for such an exemption, on or after the effective date of this Part 2A.

Water closets and associated flushing mechanisms; performance standards.
The water consumption of water closets shall not exceed an average
of 1.6 gallons per flush cycle over a range of test pressures from
20 psi to 80 psi. The fixture shall perform in accordance with the
test requirements of the ANSI A112.19.2M and ANSI A112.19.6M.

Urinals and associated flushing mechanisms; performance standards.
Urinal water consumption shall not exceed an average of 1 1/2
gallons per flush cycle over a range of test pressures from 20 to
80 psi. The fixtures shall perform in accordance with the test requirements
of ANSI A112.19.2M and ANSI A112.19.6M.

Showerheads; performance standards. Showerhead discharge rates shall
not exceed three gallons of water per minute over a range of test
pressures from 20 psi to 80 psi. The fixtures shall perform in accordance
with the test requirements of ANSI A112.18.1M.

Faucets; performance standards. Sink and lavatory faucet discharge
rates shall not exceed three gallons of water per minute over a range
of test pressures from 20 psi to 80 psi. The fixtures shall perform
in accordance with the test requirements of ANSI A112.18.1M.

Special purpose equipment. The performance standards of § 26-202 shall not apply to fixtures and fittings such as emergency showers, aspirator faucets, and blowout fixtures that, in order to perform a specialized function, cannot meet the specified standards.

Exemptions. Any person may apply to Warminster Township for an exemption
to the terms of this Part 2A, which may be granted by the Board of
Supervisors, upon proof that some other device, system or procedure
will save as much or more water as those set forth herein, or that
those set forth herein cannot be complied with, without undue hardship.

The Board of Supervisors may, from time to time, modify, add
to, or remove from the standards and restrictions herein.

Any person, firm or corporation who shall violate any provision
of this Part 2A, upon conviction thereof in an action brought before
a Magisterial District Judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part 2A continues
or each section of this Part 2A which shall be found to have been
violated shall constitute a separate offense.

The Warminster Township Municipal Authority is hereby charged
with the responsibility and is hereby empowered to determine the adequacy
of water supplies in its service area and shall make a public declaration
whenever a condition of drought watch, drought warning, or drought
emergency exists in its service area. The determination and declaration
shall be based on available water supply, weather forecasts, water
consumption and other factors as deemed appropriate by the Warminster
Township Municipal Authority.

The Warminster Township Municipal Authority is hereby empowered
to impose water use restrictions in accordance with the declared drought
conditions. Drought conditions declared which result in the imposition
of more stringent water use restrictions by the Governor of the Commonwealth
of Pennsylvania or other appropriate governmental agencies, including
the Pennsylvania Department of Environmental Protection and the Delaware
River Basin Commission, may be enforced as though such restrictions
were a part of this Part 2B. In no event, however, shall drought declaration
by the Governor or other governmental agencies reduce or lessen the
water use restrictions imposed by this Part 2B.

Whenever a water shortage exists, the Warminster Township Municipal
Authority may publicly declare, in its discretion and based upon factors
previously set forth, any one of the following conditions: drought
watch, drought warning, or drought emergency. Upon a public declaration,
the water use restrictions set forth on the attached schedule shall
be effective as of the time of the public declaration and shall remain
in effect until another public declaration of termination is made
by the Warminster Township Municipal Authority.

The Warminster Township Municipal Authority may also publicly
declare that an extreme water supply shortage exists. Upon such public
declaration, nonessential water uses shall not be permitted. During
the time of the extreme water supply shortage, water shall be used
for health and sanitary purposes only and for no other use or purpose.

All employees of the Warminster Township Municipal Authority,
and all employees of Warminster Township Police Department, as well
as all other Warminster Township employees, agents and officials are
hereby empowered to enforce the provisions of this Part 2B by the
issuance of citations and any other appropriate proceeding at law
or equity.

Any person violating, or permitting the violation of, any provision
of this Part 2B shall, upon conviction thereof in an action brought
before a Magisterial District Judge in the manner provided for the
enforcement of summary offenses under the Pennsylvania Rules of Criminal
Procedure, shall be sentenced to pay a fine of $50 to $100 for a drought
watch, $100 to $250 for a drought warning, $250 to $600 for a drought
emergency and $600 to $1,000 for extreme water supply shortage ration.
In default of payment of said fine and costs, said person shall be
sentenced to a term of imprisonment not to exceed 90 days. Each day
that a violation of this Part 2B continues or each section of this
Part 2B which shall be found to have been violated shall constitute
a separate offense.

The Warminster Township Municipal Authority is hereby empowered
to enforce all of its rules and regulations, state statutes, local
ordinances, and to impose any other appropriate remedy or remedies.
Such remedies may include, but are not limited to, an excess use surcharge
and termination of water service.

The washing of cars, trucks, buses, etc., shall be permitted

by residents of Warminster Township. The washing of such vehicles
shall be subject to complete prohibition during any drought condition

such action is in the best interest of the residents of Warminster
Township.
