A.
No person, firm or corporation shall lease to another for occupancy
any dwelling or dwelling unit nor operate a rooming house or lease
to another for occupancy any room in a rooming house unless he, she
or it shall first apply for and obtain a permit issued by the Code
Enforcement Officer. Permits for rental dwelling units shall require
renewal every three years, and rooming house permits shall require
annual renewal.
B.
Rental dwelling and dwelling unit permits shall be issued according
to the inspection schedule of the Code Enforcement Officer. Upon the
expiration of any dwelling or dwelling unit permit, a new permit shall
be required for the further period of three years. Rooming house permits
shall be issued according to the inspection schedule of the Code Enforcement
Officer. Upon the expiration of any rooming house permit, a new permit
shall be required for the further period of one year.
Any permit issued under the provisions of § 149-1 shall terminate upon the transfer of ownership of the property, and the new owner or owners shall promptly apply for a renewal of the permit.
The Code Enforcement Officer may reinspect any property for
which a permit has been issued upon receiving complaints from the
tenants thereof or from third parties.

The permit fees shall be as set forth from time to time by resolution
of the Borough Council.
If, after the Code Enforcement Officer has inspected a property
two times, said property does not meet the minimum standards for permit
issuance, then the Code Enforcement Officer can file a summary citation
with the District Justice and, upon conviction thereof, the owners
can be subject to a fine of not more than $600 or by imprisonment
not exceeding 30 days, or both such fine and imprisonment. Each day
that a violation continues shall be deemed a separate offense.
Any person, firm or corporation who shall violate any provision
of this chapter shall, upon conviction thereof, be subject to a fine
of not more than $600 or imprisonment not to exceed 30 days, or both,
at the discretion of the court. Each day that a violation continues
